The applicant has indicated that as the satellite uplink facilities previously used by "Racetrack Management" to uplink its signal to cable systems throughout Manitoba have been sold, the service is now only available to the two Winnipeg cable systems via the telephone system.
|
The applicant has also indicated that virtually the entire service will consist of live programming, including coverage of 40 races per week from Assiniboia Downs during the months of May through October exclusively and coverage of approximately 120 horse races per week during the months of November through April from horse race tracks other than Assiniboia Downs in Canada and in the United States. Canadian program content is proposed to be not less than 70% overall.
|
The Commission notes that service currently distributed by the applicant would appear to contain advertising, contrary to a condition of the licence issued to Racetrack Management (1983). The Commission will take this apparent non-compliance into consideration in determining an appropriate term for the licence sought.

The applicant is proposing 20% Canadian content over the broadcast day in Year 1, 40% in Year 2 and 60% in Year 3. Beginning in Year 4, and for the remainder of the licence term, the applicant is proposing 60% Canadian content over the broadcast day for the 1 September to end of February period, but reduced to 50% Canadian content for the 1 March 31 August period.

These proposals would entail an exception to Section 4(6) of the Television Broadcasting Regulations, 1987, which require a licensee to devote not less than 60% of the broadcast year and of any six month period specified in a condition of licence to the broadcasting of Canadian programs.

In Decision CRTC 91-853 dated 25 November 1991, the Commission approved the application by COUNTRY BROADCASTING CORP. for a broad- casting licence to carry on a (cable) distribution undertaking to serve the above-mentioned localities.
|
This licence had a condition of licence that the authorization be implemented within twelve (12) months from the date of the decision or any other extension of time that the Commission could authorize upon request before the expiry of the twelve (12) month extension.
|
The Commission subsequently granted a twelve (12) month extension of time for construction (approval letter A92-0119 dated 7 December 1992).
|
On 10 November 1993, the Commission received an application (932208200) from Country Broadcasting Corporation to amend the broadcasting licence of the (cable) distribution undertaking serving Galiano and Mayne Islands, by deleting the existing condition of licence relating to the construction and operation of the undertaking and substituting therefor:
|
"It is a condition of licence that construction of the undertaking be completed and that it be in operation on or before 25 November 1994."
|
The Commission granted another extension of time until 31 August 1994 (Decision CRTC 94-113 dated 29 March 1994).
|
Since this undertaking is still not in operation and the licensee has shown little interest in completing and operating it, the Commission hereby calls the licensee to the Public Hearing, which will be held in Saskatoon, commencing on 6 June 1994, in order to show cause as to why its broadcasting licence to serve Galiano and Mayne Islands should be renewed.

In Decision CRTC 91-275 dated 7 May 1991, the Commission approved the application by LAKE BROADCASTING CORP. for a broadcasting licence to carry on a broadcasting receiving undertaking (subscription television) (now known as a (radiocommunication distribution undertaking)) to serve the above-mentioned localities.
|
This licence had a condition of licence that the authorization be implemented within twelve (12) months from the date of the decision or any other extension of time that the Commission could authorize upon request before the expiry of the twelve (12) month extension.
|

On 10 September 1993, the Commission received an application (931496400) from Lake Broadcasting Corp. to amend the broadcasting licence of the (radiocommunication) distribution undertaking serving Monte Creek and South Thompson River Valley, by deleting the existing condition of licence relating to the construction and operation of the undertaking and substituting therefor:

"It is a condition of licence that construction of the undertaking be completed and that it be in operation on or before 1 September 1994."

The Commission granted another extension of time until 7 May 1994 (Decision CRTC 94-92 dated 22 March 1994).
|
Since this undertaking is still not in operation and the licensee has shown little interest in completing and operating it, the Commission hereby calls the licensee to the Public Hearing, which will be held in Saskatoon, commencing on 6 June 1994, in order to show cause as to why its broadcasting licence to serve Monte Creek and South Thompson River Valley should be renewed.
