Extension of construction deadline
In Public Notice CRTC 1993-177 dated 14 December 1993, the Commission announced an application submitted by Country Broadcasting Corp.
(Country) to amend the licence for the cable distribution undertaking authorized to serve Galiano and Mayne Islands, by deleting the existing condition of licence relating to the construction and operation of the undertaking and substituting therefor:
 It is a condition of licence that construction of the undertaking be completed and that it be in operation on or before 25 November 1994.
The Commission notes that this is the second extension to the time limit for implementation of this undertaking. Country stated in its application that it intends to be in operation in April 1994, pending receipt of a permit from the Ministry of the Environment authorizing the licensee to cross Active Pass with submarine cable in order to link the islands.
The Commission feels that the above circumstances should have been foreseen by Country. Accordingly, it is prepared to grant an extension to 31 August 1994 only to coincide with the licence expiry date.
The existing condition of licence relating to the construction and operation of the undertaking is therefore deleted and the following substituted therefor:
 It is a condition of licence that construction of the undertaking be completed and that it be in operation on or before 31 August 1994.
Shaw Communications Inc. (Shaw) submitted an opposing intervention arguing that Country has had sufficient time, since its initial licensing, to have completed construction and implementation of the undertaking to serve Galiano and Mayne Islands. The intervener expressed interest in providing cable service to these communities.
In response, Country outlined numerous additional factors that it felt had delayed the construction of the cable system. Country noted that it is experienced in serving small, rural communities and claimed that the rural public is well served by operators of small systems.
The Commission notes that Country has indicated its intention to have the system in operation by the end of April 1994.
The Commission therefore expects the licensee to submit, by no later than 30 April 1994, a progress report confirming that the cable system is indeed in operation, or providing evidence that the necessary steps have been taken to complete construction.
The Commission intends to discuss the implementation of the cable system with the licensee when it considers the renewal of its licence.
