  PREAMBLE
  Items 1 to 11
  These items were first scheduled to be heard at a public hearing on 3 December 2007 (Notice of Public Hearing CRTC 2007-13, 4 October 2007) but were withdrawn to be rescheduled at a later date.
  On 22 June 2007, the Commission issued Broadcasting Public Notice CRTC 2007-66 calling for applications for broadcasting licences to provide radio programming services for Ottawa, Ontario and Gatineau, Quebec.
  In response to this call, the Commission has received a number of applications for licences to serve this area.
  Some of these applications are technically mutually exclusive. The applications are:
 

Items 4, 7, 8, 9 and 11 are technically mutually exclusive proposing the use of the frequency 99.7 MHz.

 

Items 1, 2, 3, 5, 6 and 10 are technically mutually exclusive proposing the use of the frequency 101.9 MHz and 101.7 MHz.

  These items will be treated as competitive radio applications for the Ottawa/Gatineau market.
  The Commission will consider the interventions already received, accepted and filed on the public file for the 3 December 2007 hearing as well as other interventions received in the context of this Public Hearing.

  Application by Instant Information Services Incorporated relating to the licence of the English-language FM commercial tourist radio programming undertaking CIIO-FM Ottawa.
  The licensee is currently operating the low power station on frequency 99.7 MHz (channel 259LP).
  The licensee proposes to change the authorized contours by increasing the effective radiated power from 25 watts to an average effective radiated power of 427 watts (maximum effective radiated power of 1,000 watts/antenna height of 82.5 metres).
  The authorized contours of the transmitter will be increased significantly resulting from the proposed increase in power.
  The Commission notes that the increase in power would change the status of CIIO-FM Ottawa from an unprotected low power service to a regular Class A service.
  The licensee indicates that it now has an agreement in development with the City of Ottawa, to become the Designated Broadcast System in the event of an emergency. Since Ottawa's land mass encompasses almost 4,700 square kilometres, accomodating a population of more than 1.1 million, the signal from its low power FM station will not reach many of the people who may be affected by an emergency.

a second set of signals that provides the programming of the four U.S. commercial networks (CBS, NBC, ABC, FOX) and the non-commercial PBS network (hereafter referred to as the U.S. 4+1 signals).

  The distribution on a discretionary basis on the licensee's digital services of a second set of signals that provides the programming of the U.S. 4+1 signals and the distant Canadian television signals set out in the List of Part 3 eligible satellite services is subject to the provision that, with respect to such signals, the licensee adhere to the requirements regarding non-simultaneous program deletion set out in section 43 of the Broadcasting Distribution Regulations. The Commission may suspend the application of this provision, with respect to the signals to be distributed, upon its approval of an executed agreement between the licensee and broadcasters. Such an agreement must deal with issues related to the protection of program rights arising in connection with the discretionary carriage of a second set of U.S. 4+1 signals and distant Canadian signals solely on the licensee's digital service.
 

ii) The licensee may, at its option, insert certain promotional material as a substitute for the "local availabilities" (i.e. non-Canadian advertising material) of non-Canadian satellite services. At least 75% of these local availabilities must be made available for use by licensed Canadian programming services for the promotion of their respective services, for the promotion of the community channel, and for unpaid Canadian public service announcements. A maximum of 25% of the local availabilities may be used for the promotion of discretionary programming services and packages, to provide subscribers with information regarding customer service and channel realignments, for cable FM service, additional cable outlets and non-programming services, including Internet and local telephone services.

  The applicant proposes to put in place one community channel serving Drummondville, and surrounding areas and Saint-Hyacinthe, and surrounding areas.
