  Application by CANAL ÉVASION INC. to amend the conditions of licence of the national French-language specialty television service known as Canal Évasion.
  The licensee proposes to amend the following conditions of licence:

- to reduce the distribution of Canadian programming from 60% of the broadcast day and 60% of the evening period to not less than 45% of the broadcast day and the evening period;

 

- to increase the amount of its annual budget for acquiring the rights to original Canadian programming on programs produced by companies that are shareholders or affiliated companies from 25% to 45% until the end of the current licence term;

 

- to reduce the percentage of gross revenues devoted to investment in Canadian programming from 50% to 42% for an interim period ending 31 August 2007; and

 

- to amend the nature of its service by adding program category 10, Game Shows, to the list of categories that the licensee is authorized to distribute.

  In its application, the licensee also proposes increasing the gross monthly rate from $0.49 to $0.80. The Commission notes that, as indicated in paragraph 16 of CRTC Decision 99-112, the $0.49 gross monthly rate is not regulated by the Commission, however, the rate should be negotiated with the distributors.

  Application by GENEX COMMUNICATIONS INC. relating to radio CKNU-FM Donnacona, to delete the condition of licence set out in Decision CRTC 98-502, restricting the solicitation of advertising to the Portneuf area.
  This application was filed following Decision CRTC 2002-190, July 16, 2002, in which the Commission, by majority vote, denied the application by Genex Communications Inc. to amend the broadcasting licence of CKNU-FM Donnaconna to expand the station's contour to include Quebec City, amend the condition of licence restricting the solicitation of advertising and amend the condition of licence related to local programming.
  With respect to the application, the applicant submits that deleting the condition of licence restricting the solicitation of advertising to the Portneuf area would serve the public interest in Portneuf and at the same time allow the station to access a larger advertising pool, i.e., Quebec City.
  The applicant states that this application:
 

1) responds to the need to improve the station's financial position;

 

2) will allow the station to meet the needs of a section of the Portneuf audience who shop for goods and services in Quebec City; and

 

3) makes allowance for the economic situation of Quebec City, an area bordering the Portneuf area that constitutes the service area of CKNU-FM.

  Application by RADIO DU GOLFE INC. relating to a new transmitter of CJMC-FM Sainte-Anne-des-Monts at La Martre, authorized in Licence amendment for CJMC-FM Sainte-Anne-des-Monts, Decision CRTC 2001-28, 25 January 2001.
  The licensee proposes to change the frequency from 103.1 MHz (channel 276LP) to 92.7 MHz (channel 224LP).
  The licensee is also requesting an extension of time limit, till 25 July 2003, to implement the service.
  The Commission notes that this is the third request for an extension of time limit.
  The first request for an extension of time limit, from 25 January 2002 to 25 July 2002, was approved in Decision CRTC 2002-100, dated 22 April 2002. The second request for an extension, to 25 January 2003, was approved in Decision CRTC 2002-314, dated 16 October 2002.
  This application requires an amendment to the licence of radio station CJMC-FM Ste-Anne-des-Monts, the mother station.

  The licensee proposes to change the frequency from 89.5 MHz (channel 208LP) to 99.3 MHz (channel 257A) and to increasethe effective radiated power from 33 to 800watts.
  The Commission notes that the proposed increase in power would result in a change of the CJTK-FM-1's status from a low-power to a regular Class "A" FM station.
  The licensee states that it has received many complaints about poor reception in low-lying areas. It believes that an increase in power will provide a stronger signal that should improve reception to those parts of the service area currently receiving an unsatisfactory signal.
  This application requires an amendment to the licence of radio station CJTK-FM Sudbury, the originating station.

  CFCL-TV was previously licensed to CTV Television Inc. (CTV) until the Commission approved, in Decision CRTC 2002-303, dated 10 October 2002, the purchase of this station by CBC and the addition of CFCL-TV to the licence of CBLT Toronto.
  For this reason, the CBC notes that it is no longer necessary to hold separate RDU licences for these transmitters.
  Should this application be approved, the Commission will revoke the RDU licences issued to CBC.

  The transmitters will operate on channel 15 with an effective radiated power of 14,200 watts at Temagami (CBCQ-TV-1), and on channel 12 with a transmitter power of 10 watts at Fort Hope (CBLHT).
  The CBC notes improvements in satellite feed technology now allows them to feed these communities the full CBLT program schedule from Toronto.
  The two transmitters are presently licensed to the CBC as radiocommunication distribution undertakings (RDU) which expire 31 August 2003. These transmitters currently rebroadcast the programming of the CBC Northern Television Service.

  The above-noted transmitter is presently licensed to the CBC as a radiocommunication distribution undertaking (RDU) which expires 31 August 2003. This transmitter currently distributes the programming service of CKBI-TV Prince Albert, Saskatchewan.
  CKBI-TV was previously licensed to CTV Television Inc. (CTV) until the Commission approved, in Decision CRTC 2002-302, dated 10 October 2002, the purchase of this station by CBC and the addition of CKBI-TV to the licence of CBKST Regina as a transmitter of this station.
  For this reason, the CBC notes that it is no longer necessary to hold a separate RDU licence for this transmitter.
