Licence amendment for COOL TV - Addition of a program category

  The Commission approves an application to amend the licence for COOL TV by adding to the list of program categories that may be broadcast by the service.

The Commission received an application by Global Television Network Inc. (Global) to amend the broadcasting licence of the national English-language Category 2 specialty television undertaking, COOL TV (formerly known as The Jazz Channel), in order to add category 2b (long-form documentary) to the list of categories from which the licensee may draw its programming.

In The Jazz Channel, Decision CRTC 2000-563, 24 November 2000 and 14 December 2000, the Commission imposed the following condition of licence defining the nature of service that The Jazz Channel could provide:
 

1.a) The licensee shall provide a national English-language Category 2 specialty music video television service dedicated to jazz, blues and world music. Programming will range from coverage of music festivals and live performances to concerts, documentaries and interview programs.

 

b) The programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990: 7c, 7d, 8a, 8b, 8c, 9, 11, 12, 13 and 14.

 

c) A minimum of 25% of all programming broadcast during the broadcast week shall be devoted to the exhibition of programming featuring music video clips (category 8b).

 

d) No more than 15% of all programming broadcast during the broadcast week shall be drawn from category 7.

The applicant indicated that the addition of category 2b would correct an oversight in its original application, and that this category is consistent with COOL TV's nature of service.

One intervention offering comments on this application was submitted by Corus Entertainment Inc. (Corus). Corus controls the licensee of the category 1 digital specialty television service known as The Canadian Documentary Channel. Corus stated that it did not object to the inclusion of Category 2b in the list of permitted programming for COOL TV. However, to reduce the possibility that COOL TV would become competitive with The Canadian Documentary Channel, Corus requested that the Commission impose a limit on the amount of programming that COOL TV may broadcast from category 2b.

The Commission notes that in The Jazz Channel, Decision CRTC 2000-533, 14 December 2000, and in Jazz & Blues TV, Decision CRTC 2000-547, 14 December 2000, services similar to that offered by COOL TV were authorized to draw programming from category 2b.

The Commission is satisfied that the broadcast of programming from category 2b would be consistent with COOL TV's nature of service. Accordingly, the Commission approves the application by Global to amend COOL TV's condition of licence 1.b) to read as follows:
 

The programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990:  2b, 7c, 7d, 8a, 8b, 8c, 9, 11, 12, 13 and 14.

7.

The Commission reminds the licensee that any long-form documentaries must conform to condition of licence 1.a), which requires that all programming broadcast on COOL TV be related to jazz, blues and world music.
