The Commission will hold a public hearing commencing on 8 July 1996, at the Radisson Hôtel des Gouverneurs, 690 René-Lévesque Boulevard East, Quebec City, Quebec, to consider the following:

ATLANTIC AND QUEBEC REGION / RÉGION DE L'ATLANTIQUE ET DU QUÉBEC

1. A LMA, Quebec
|
Application (199602131) by RADIO CKYK FM INC. to amend the broadcasting licence of the (radio) programming undertaking CKYK-FM Alma, as follows:
|
- by relocating the current antenna site near Chambord, Quebec, to a site located east of Larouche, Quebec, thus relocating its current contours towards the east;
|
- by changing the frequency from 95.5 MHz (channel 238B) to 95.7 MHz (channel 239 C1); and
|
- by increasing the effective radiated power from 50,000 to 100,000 watts.
|
The licensee states that these changes will help solve the reception difficulties it has with CKYK-FM in the City of Alma, the core of its market.
|
The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that it is technically acceptable.

The Commission provides notice to the licensee that it wishes to discuss at the hearing the numerous complaints received by the Commission since the last renewal concerning certain statements made on programs broadcast by CKRS, as well as the appropriateness of the Commission imposing, as a condition of licence, that the licensee abide by its policy concerning content.
|
After reviewing certain complaints against CKRS, the Commission expressed its preliminary view that certain comments made would appear to constitute a violation of the said policy.

The Commission notes the apparent failure of the licensee to comply with subsection 2.2(5) of the Radio Regulations, 1986 concerning the broadcast of French-language vocal music.

Consequently, the Commission expects the licensee to show cause at this hearing why a mandatory order should not be issued requiring the licensee to comply with subsection 2.2(5) of the Radio Regulations, 1986.

BACKGROUND OF NON-COMPLIANCE BY CHOC-FM
|
The Commission notes that it will not be the first time that the licensee has appeared before the Commission since beginning of 1986 CHOC-FM was found to be in non-compliance on six occasions:
|
- in 1986 and in 1988, for failure to comply with various Promises of Performance commitments on the basis of which the licensee was limited to two two year renewals;
|
- in 1990, non-compliance concerning logger tapes, on the basis of which the licensee was limited to a one year renewal;
|
- in 1991, non-compliance concerning the Promise of Performance and logger tapes, on the basis of which the licensee was limited to an eight month renewal;
|
- in 1992, non-compliance concerning logger tapes, on the basis of which the licensee was limited to a two year renewal; and
|
- in 1994, non-compliance concerning logger tapes and Category 3 music (Traditional and Special Interest), on the basis of which the licensee was limited to a two year renewal. The Commission has issued a mandatory order concerning the logger tapes.

Application (199606737) by LES ENTREPRISES DE RADIODIFFUSION DE LA CAPITALE INC. to renew the broadcasting licence of the (radio) programming undertaking CHOI-FM Quebec City expiring 31 August 1996, under the same terms and conditions as the current licence.

In Decision CRTC 95-119 dated 27 March 1995, the Commission approved the applications of Télémédia Communications inc. (Télémédia) to gain effective control of "Les Entreprises de Radiodiffusion de la Capitale inc.".
|
In the above decision the Commission noted that Télémédia is also owner of station CITF-FM Québec City. The Commission has had a long-standing policy that two radio undertakings of the same type serving the same market in the same language must not have the same owner.
|
Accordingly, the Commission required that an application to transfer the ownership or effective control of CHOI-FM to a third party be filed within six months after the date of the decision (27 March 1995). If Télémédia was unable to file such an application within that period, it was required to place CHOI-FM in trust until a decision was issued by the Commission.
|
On 18 September 1995, Télémédia filed a contract between Price Waterhouse Inc. and Télémédia Communications inc. relating to the administration and management of CHOI-FM. The Commission approved the contract by administrative letter A95-0126 dated 26 September 1995. The Commission added: TRANSLATION "The Commission approves the management contract as filed and , in consequence thereof, the transfer of effective control of ERC to the manager until a purchaser is approved by the Commission".
|
On 20 February 1996, the Commission requested Price Waterhouse Inc. to submit a report on the procedures and measures taken to date to offer station CHOI-FM for sale. Price Waterhouse Inc. forwarded the letter to Télémédia Communications inc. who then submitted its report dated 6 March 1996.
|
The Commission calls at the hearing Télémédia Communications inc. to appear in order to discuss the reasons why the Commission should renew the broadcasting licence of the (radio) programming undertaking CHOI-FM Quebec City.

The Commission notes the apparent failure of the licensee to comply with the following requirements:

- subsection 2.2(5) of the Radio Regulations, 1986 (the Regulations) concerning the broadcast of French-language vocal music;
|
- section 8 of the Regulations concerning the provision of logger tapes; and
|
- conditions of licence concerning the broadcast of Canadian Content for Category 2 music (General Music) and Category 3 music (Traditional and Special Interest).

The Commission expects the licensee to show cause at this hearing why mandatory orders should not be issued requiring the licensee to comply with subsections 2.2(5), section 8 of the Radio Regulations, 1986 and with its conditions of licence concerning the broadcast of Canadian Content.

- in 1992, non-compliance concerning logger tapes and Category 3 music (Traditional and Special Interest), on the basis of which the licensee was limited to a two year renewal; and
|
- in 1994, non-compliance concerning logger tapes, on the basis of which the licensee was limited to a two year renewal. The Commission has issued a mandatory order concerning the logger tapes.

PROPOSED FEE

The applicant proposes to charge a basic monthly fee of $29.91 for the distribution of the basic service. For Part III licensees, the basic monthly fee is not regulated pursuant to the Cable Television Regulations, 1986.

The Commission expects the licensee to show cause at this hearing why a mandatory order should not be issued requiring the licensee to comply with subsection 2.2(3) of the Radio Regulations, 1986 and with its condition of licence concerning the broadcast of category 3 music.
