Listes révisées des services par satellite admissibles

Les trois listes qui figurent en annexe remplacent celles annexées à l'avis public CRTC 2000-133 du 22 septembre 2000.

Ajout de CJOH-TV (CTV) Ottawa à la liste des services par satellite admissibles en vertu de la partie 3

Dans la décision CRTC 2000-412du 18 octobre 2000, le Conseil a approuvé les demandes présentées par Les Communications par satellite canadien inc. et SC SRDU Services Inc. (anciennement Star Choice Television Network Incorporated) visant à ajouter CJOH-TV (CTV) Ottawa à la liste de services que leurs entreprises nationales de distribution par relais satellite sont autorisées à distribuer.

La liste de services par satellite admissibles en vertu de la partie 3 en annexe du présent avis a été modifiée en conséquence. La liste de services par satellite admissibles en vertu de la partie 2 et celle des services par satellite admissibles distribués par SRD demeurent inchangées mais sont jointes à titre d'information.

A pay audio programming undertaking may not be used for linkage purposes for the distribution of any non-Canadian eligible satellite services.

Playboy TV is only authorized for distribution at the specific request of a subscriber. Distributors are not permitted to package Playboy TV in such a way that subscribers are obligated to purchase Playboy TV in order to purchase any other programming service. Distributors are required to take measures to fully block the reception of both the audio and video portions of Playboy TV to subscribers that request it not be receivable in their home (in either unscrambled or scrambled analog form).

Authorization for the above-noted services is subject to the following:

- When this list of Part 2 eligible satellite services is replaced by another list of Part 2 eligible satellite services, the only authorized services will be those contained in the most recent list; accordingly, this list supersedes the list dated 22 September 2000.

- In the case of signals received from a licensed SRDU, ASN, the CBC English- and French-language Television Services and U.S. satellite services, licensees are required to enter into the necessary contractual arrangements for such carriage.

Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.

- In the case of out-of-province educational services, there should be no objection on the part of the originating service.

- In the case of a licensed SRDU signals, ASN, and the CBC English- and French-language Television Services, licensees are required to enter into the necessary contractual arrangements for such carriage.

In the case of CFTM-TV, CFCM-TV and CHLT-TV; CFTO-TV, CFCF-TV, CHAN-TV, CJON-TV, CJCH-TV, CJOH-TV, CFRN-TV, CFCN-TV, CKCO-TV, CKCK-TV, CKCW-TV, CHEK-TV, CKY-TV, CJCB-TV and CKLT-TV, a licensee also distributing the signal of a local TVA or CTV affiliate shall delete the duplicate programming from the services received from a licensed SRDU or substitute the local service(s) when the programming is identical.

Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.
