ASL – CRTC criteria for review and vary applications

Under section 62 of the Telecommunications Act, the Commission can review and, if necessary, vary its decisions.

The Commission can use this power to revisit a past decision and make changes to correct any errors or oversights, or to reflect changed circumstances.

Anyone can file an application asking the Commission to do this. These applications are commonly referred to as “review and vary applications” or “R&V applications”.

If you file a review and vary application, it is your opportunity to demonstrate that there is substantial doubt that the original decision is correct. This could be because:

  • The Commission made an error in law or in fact in the decision;
  • There has been a fundamental change in circumstance or facts since the Commission made the decision;
  • The Commission did not consider a basic principle in making the decision; or
  • A new principle has arisen because of the decision

A review and vary application is not meant to be a chance to:

  • re-state views you have already presented to the Commission; or
  • express simple disagreement with the Commission’s decision and request a new outcome.

When you file a review and vary application, other parties also have a chance to comment. The Commission assesses the information filed (also known as the “record” or “public record”) and determines whether there is substantial doubt that the decision is correct. If there is, the Commission can consider changing its decision.

It is important to remember that it is up to you as the applicant to demonstrate substantial doubt.
