Subject: Request to stay the requirement to file a cost study – Follow-up to Telecom Order CRTC 2022-97.

Dear Madams/Sirs,

On 5 April 2022, the Commission issued Telecom Order 2022-97,Footnote1 which ordered Videotron to file, within 60 days of the date of the order,Footnote2 a cost study in support of Videotron Ltd. (Videotron) 1001 to 1500 Mbps download tier of its aggregated service (aggregated 1.5 Giga service). On 3 June 2022, the Commission granted Videotron an extension for the filing of its cost study until 19 July 2022.

On 22 June 2022, the Commission received from Quebecor Media Inc. (“Quebecor Media”), on behalf of Videotron, Tariff Notice (TN) 60 in order to destandardize the aggregated 1.5 Giga service and to remove the disaggregated 1.5 Giga service from Videotron’s third-party Internet access (TPIA) tariffFootnote3 effective 21 August 2022. That same day, the Commission also received a letter from Videotron requesting that the Commission remove the requirement set out in Telecom Order 2022-97 that the company file a cost study for the speed tier of the aggregated 1.5 Giga service.

On 14 July 2022, the Commission received a new letter from Videotron requesting that the Commission suspend Videotron’s obligation to submit a cost study until the Commission has rendered its decision in TN 60.

The Commission is of the view that Videotron’s requirement to file a cost study and its request for destandardization ought to be considered together. Given that the destandardization request cannot be considered until the Commission has a complete record, that is to say, prior to the deadline for comments and reply comments, the Commission finds that an interim suspension of the cost study filing requirement stipulated in Telecom Order 2022-97 pending the Commission’s decision in TN 60 is reasonable.

In view of the circumstances, the Commission grants Videotron an interim stay from the obligation to provide a cost study for the aggregated 1.5 Giga service until the date of the Commission’s decision with respect to TN 60. Should the Commission retain the requirement to file a cost study for the aggregated 1.5 Giga service, it will set a new due date for this cost study in the decision with respect to TN 60.
