The licensee proposes to replace the condition of licence relating to its nature of service, which reads:

The licensee shall provide a national French-language Category 2 specialty programming undertaking aimed exclusively at children from two to six years old.

with the following condition:

The licensee shall provide a national French-language Category 2 specialty service aimed exclusively at children from two to six years old, except in the period after 9 p.m., when the service may broadcast programming on subjects of interest to parents of young children.

The licensee states that it wants to broadcast programming relevant to the parents of young children in order to complete its broadcast schedule after 9 p.m., since the primary target group for this service is no longer watching during the period in question.

The licensee states this frequency change is needed as a result Broadcasting Decision 2009-224 in which the Commission granted a licence to Maritime Broadcasting to operate a station 101.7 MHz in Amherst.

All other technical parameters remain unchanged.

The licensee states that this increase is necessary to enable listeners to receive the signal, without interference in homes and buildings located within the authorized 3 mV/m contour.

The licensee proposes to change the authorized contours by increasing the effective radiated power from 499 watts to 3,400 watts (non-directional antenna with a decrease in the effective height of antenna above average terrain from 108.7 metres to 103.3 metres). All other technical parameters remain unchanged.

The licensee states that this increase is justified by a serious signal penetration problem within the authorized 3 mV/m contour. Some listeners have complained that they cannot receive CHUN-FM’s signal inside their residence.

Application by 9202-1617 Québec inc. to amend the broadcasting licence of the French-language commercial radio programming undertaking CKGS-FM Saguenay (zone La Baie).

The licensee proposes to add an FM transmitter at Mont Ste-Claire to broadcast the programming of CKGS-FM Saguenay in order to adequately serve the population of Chicoutimi and Jonquière. According to the licensee, these changes will improve the quality of CKGS-FM’s signal particularly in those districts.

The transmitter would operate on frequency 105.9 MHz (channel 290A1) with an average effective radiated power of 57 watts (maximum effective radiated power of 250 watts with an effective height of antenna above average terrain of 51.1 metres).

The Commission notes that the population will increase from 29,294 to 47,810 in the 3 mV/m contour and decrease from 81,183 to 61,350 in the 0.5 mV/m contour.

Application by Newcap Inc. to amend the broadcasting licence of the English-language commercial radio programming undertaking CILV-FM Ottawa.

The licensee is seeking an amendment to its condition of licence relating to contributions to Canadian Content Development (CCD).

The licensee is requesting the flexibility to carry forward balances of CCD amounts paid or payable. More specifically, the licensee requests that, due to the fluctuating nature of its ‘‘Big Money Shot’’ local CCD initiative, its cumulative CCD spent for this initiative be permitted to vary up to 20% annually from the cumulative commitment according to its condition of licence. However, the licensee has committed to have all CCD funds disbursed in their entirety by 31 August 2013.

It appears to the Commission that the licensee may have failed to comply with its condition of licence relating to Canadian Talent Development, and more specifically with the ‘‘Big Money Shot’’ initiative, in broadcast year 2006 and 2007 since the annual contributions were not paid in full by the end of 2006 (prorated amount) and 2007.

The licensee is seeking an amendment to its condition of licence relating to contributions to Canadian Content Development (CCD).

The licensee proposes that a portion of the amount contributed to the ‘‘Making of a Band’’ initiative in 2009 be transferred to the 2010 broadcast year and that the balance caused by the reduction in the 2009 amount be added to the 2014 broadcast year.

The licensee is also requesting flexibility to carry forward the balances of CCD amounts paid or payable. More specifically, the applicant requests that, due to the fluctuating nature of its ‘‘Making of a Band’’ local CCD initiative, its cumulative CCD spent for this initiative be permitted to vary up to 20% annually from the cumulative commitment amount according to its condition of licence. The licensee states that, because electrical and other interference levels have increased and the expectations of the population with regard to quality have risen, the low-power AM signal has become unreliable and unsatisfactory.

The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. In such a case, the intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
