CFNR-FM Terrace – New transmitters at Alkali Lake and Fort Babine; addition of various rebroadcasting transmitters throughout northern British Columbia
1. The Commission approves the application by Northern Native Broadcasting (Terrace, B.C.) (Northern Native) to amend the broadcasting licence for the English- and Aboriginal-language Native Type B radio programming undertaking CFNR-FM Terrace in order to add low-power rebroadcasting transmitters at Alkali Lake and Fort Babine, British Columbia, and to add to that licence various low-power rebroadcasting transmitters that are currently in operation and are located throughout northern British Columbia. Information relating to the technical parameters for all of these transmitters and to the locations of the rebroadcasting transmitters that are currently in operation is set out in the appendix to this decision. The Commission did not receive any interventions in connection with this application.
2. Northern Native stated that it was under the mistaken impression that the currently operating low-power rebroadcasting transmitters would be considered exempt from licensing in light of the Exemption order respecting certain native radio undertakings, set out in Appendix 1 to Exemption order respecting certain native radio undertakings, Public Notice CRTC 1998-62, 9 July 1998.
3. In regard to the rebroadcasting transmitters at Alkali Lake and Fort Babine, the Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue broadcasting certificates when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
4. The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met and that broadcasting certificates will be issued.
5. The transmitters at Alkali Lake and Fort Babine must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 10 December 2011. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before that date.
6. Given that all of the rebroadcasting transmitters that are the subject of the present decision are low-power unprotected FM services, the Commission also reminds the licensee that it will have to select other frequencies if the Department so requires.
