Re: Review of the regulatory requirements to provide information to customers using various means of communications in light of Telecom Decision 2008-34, Telecom Public Notice CRTC 2008-7 - Survey filed by the Yellow Pages Group

Dear Sir or Madam:

This letter is in response to a request made by the Public Interest Advocacy Centre, on behalf of the Consumers’ Association of Canada and National Anti-Poverty Organization (the Consumer Groups), in their reply comments dated 31 July 2008.

The Consumer Groups noted that a telephone survey conducted by Ad Hoc Research on behalf of the Yellow Pages Group (YPG) on the usage of various sections of telephone directories provided by incumbent local exchange carriers (the survey) was referenced in paragraphs 10 and 23 of the YPG’s reply comments, and summarized in a three page power point presentation included in Attachment 1 to the YPG’s reply comments.

The Consumer Groups requested that the survey contained in the reply comments of the YPG be struck from the record.  In the alternative, the Consumer Groups submitted that parties should be permitted to obtain a full copy of the survey, with methodology, “cross-tabs” and confidence intervals, etc. and that the Commission grant parties seven days after receiving copies of the survey to reply to the matter raised by it.

Commission staff considers that new evidence should not be introduced at the reply stage and that the reference to the survey in YPG’s reply comments was not sufficiently detailed.  In keeping with the rules of natural justice, the full survey, including methodology, should be placed on the record and parties should be afforded an opportunity to reply.

YPG is therefore requested to file with the Commission, copying all other parties, a copy of the survey, the survey methodology including the data relating to sampling information and the margin of error associated with each result concerning the information pages, along with a copy of the questionnaire used for the survey by Thursday, 28 August, 2008.  Parties may file reply comments limited to the material filed by YPG in response to this letter with the Commission, copying all other parties, by Friday, 12 September, 2008.   Commission staff notes that where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.

In the event that YPG does not provide the requested information, references to the survey and all related comments made by YPG in its reply comments may be struck from the record of the proceeding.

Commission staff also reminds the parties of Telecommunications Circular 2007-16 (available at http://www.crtc.gc.ca/eng/archive/2007/ct2007-16.htm) which requests that parties file all documents through the Epass system to ensure that they are properly filed and distributed.
