Program log requirements for television programming undertakings |

The Commission approves an application to amend the broadcasting licences of the television stations CHOT-TV Gatineau, CFEM-TV Rouyn-Noranda, CFGS-TV Gatineau, CFVS-TV Val-d'Or and CKRN-TV Rouyn-Noranda in order to exempt the licensee from its obligations with respect to the furnishing of program logs or records. |

The Commission received an application by RNC Média inc. to amend the broadcasting licences for the television programming undertakings CHOT-TV Gatineau (TVA), CFEM-TV Rouyn-Noranda (TVA), CFGS-TV Gatineau (TQS), CFVS-TV Val-d'Or (TQS) and CKRN-TV Rouyn-Noranda (Canadian Broadcasting Corporation [CBC]) by adding a condition of licence exempting the licensee from the requirements related to program logs or records set out in section 10(3) of the Television Broadcasting Regulations, 1987 (the Regulations). |

Commission's analysis and determinations |

In Broadcasting Public Notice 2006-109, the Commission amended the Regulations to enable it to exempt a licensee, by condition of licence, from the requirement the furnish identical records in order to streamline the process of filing of records with the Commission. |

The Commission notes that the logs and records of the regional stations CHOT-TV Gatineau (TVA), CFEM-TV Rouyn-Noranda (TVA), CFGS-TV Gatineau (TQS), CFVS-TV Val-d'Or (TQS) and CKRN-TV Rouyn-Noranda (CBC) are true copies of the logs of the network stations with the exception of local programming segments. The Commission therefore considers that the licensee may be relieved of the requirement to furnish complete records of the programming broadcast by the stations listed in this application. |

Accordingly, the Commission approves the application by RNC Média inc. to amend the broadcasting licences of the television programming undertakings CHOT-TV Gatineau (TVA), CFEM-TV Rouyn-Noranda (TVA), CFGS-TV Gatineau (TQS), CFVS-TV Val-d'Or (TQS) and CKRN-TV Rouyn-Noranda (CBC) by adding the conditions of licence set out in the appendix to this decision. |

The licensee shall use the Commission's existing computerized log system in order to allow the Commission to continue to validate its requirements relating to local production and captioning. To ensure compatibility with its computerized system, the Commission further requires that the logs be filed on a quarterly basis and contain the information required for each month in the quarter. The quarterly logs will follow the broadcast year. Accordingly, the first quarter of each broadcast year will begin on 1 September. |

The licensee may use the new procedure for filing logs with the Commission beginning in the broadcast year commencing 1 September 2009. |

Conditions of licence for the television programming undertakings CHOT-TV Gatineau (TVA) and CFEM-TV Rouyn-Noranda (TVA) |

1. The licensee is exempted from the requirements related to program logs set out in subsection 10(3) of the Television Broadcasting Regulations, 1987 where the stations' programming is the same as the programming broadcast by CFTM-TV Montréal.

2. For the purpose of validating the requirements relating to local programming and closed captioning of local programming, the licensee shall furnish quarterly program logs for the local programming broadcast by each of the stations CHOT-TV Gatineau and CFEM-TV Rouyn-Noranda using the Commission's computerized system. Such logs shall be furnished to the Commission within 30 days following the end of each quarter.
