On 12 March 2007, the Commission issued Broadcasting Public Notice CRTC 2007-25 calling for applications for broadcasting licences to provide radio programming services from Kelowna, British Columbia.

In response to these calls, the Commission has received a number of applications for licences to serve this market.
|

Some of the applications are technically mutually exclusive. These applications are:

Items 1 to 7 and 11 are technically mutually exclusive proposing the use of the frequency 96.3 MHz.
|
|
These applications along with items 8, 9 and 10 will be treated as competitive radio applications for Kelowna.

The proposed station would maintain its current oldies music format.
|
|
Approval of this application will see the licensee exceed the ownership limits for commercial radio licensees as set out in Public Notice CRTC 1998-41, Commercial Radio Policy 1998. Under the policy, in markets with 8 commercials stations or more, operating in a given language, such as Halifax, a person may be permitted to own or control as many as 2 FM stations in the same language. In the case of CHUM Limited, approval of its CJCH Halifax conversion application will see the licensee own the new FM along with its existing Halifax commercial radio holdings CIOO-FM and 50% of CKUL-FM.

CHUM has indicated that in the event that the Commission approves its application to convert CJCH from the AM to the FM band, it will divest its interest in CKUL-FM so as to comply with the Commission's common ownership policy.
|
|
The applicant is requesting permission to simulcast the programming of the new FM station on CJCH for a period of 3 months from the date of implementation of the new station.
|
|
The applicant is also requesting, pursuant to sections 9(1)(e) and 24(1) of the Broadcasting Act, the revocation of the licence of CJCH effective at the end of the simulcast period.

In Decision 2006-644, CFAB Windsor - Conversion to FM band, the Commission approved in part an application by MBS to operate a new English-language FM radio programming undertaking in Windsor. However, the Commission did not approve the proposed frequency 92.9 MHz (channel 225C1) with an average effective radiated power of 47,000 watts.
|
|
The present application is filed in response to Decision CRTC 2006-644 in which the Commission stated that it would only issue a licence to MBS if it submitted an application proposing the use of another FM frequency and technical parameters that are acceptable to both the Commission and the Department of Industry.
|
|
The applicant has requested an exemption to the Commission's common ownership policy (the policy). Specifically, approval of this application will see the licensee exceed the ownership limits for commercial radio licensees as set out in Public Notice CRTC 1998-41, Commercial Radio Policy 1998 (the policy). Under the policy, "in markets with less than eight commercials stations operating in a given language, a person may be permitted to own or control as many as three stations operating in that language, with a maximum of two stations in any one frequency band. In markets with eight commercials stations or more operating in a given language, a person may be permitted to own or control as many as two AM and two FM stations in that language." In the case of MBS, approval of these technical parameters will see the new Windsor FM station overlap the 3 mV/m contours of CKEN-FM and CKWM-FM, both serving Kentville. It would also see the proposed station overlap the 3 mV/m contours of CHFX-FM and CHNS-FM1, both serving Halifax.

The licence expires 31 August 2008.

In Community Radio Policy, Public Notice CRTC 2000-13, 28 January 2000, the Commission stated that developmental radio stations would generally be licensed for three years. At the end of this term, licensees will be expected to have filed an application with the Commission for a standard community radio licence, or to cease operations. The licensee has filed these applications in response to this policy and recent applications for full power commercial stations in Kingston.

Rogers is the current licensee of CICX-FM Orillia and Larche, a wholly-owned subsidiary of Larche Communications Inc., is the current licensee of CIKZ-FM Kitchener.

Pursuant to the agreement between Rogers and Larche, Rogers would purchase the assets of CIKZ-FM Kitchener for $12.2 million. Payment of that price would include the transfer of the CICX-FM Orillia assets to Larche for an assessed value of $4 million. Some of the remainder would be paid by Roger's delivery of a promissory note, which would, in turn, be used for the redemption of the 29.9% ownership interest held by Rogers in Larche (value of $4 million). The remaining $4.2 million would be a cash sum provided to Larche.

Pursuant to the Commercial Radio Policy, 2006 (Public Notice 2006-158,
15 December 2006), Rogers proposes tangible benefits of $732,000 for the Kitchener station (CIKZ-FM) over a seven-year period, representing 6% of the $12.2 million. Similarly, Larche will contribute a total of $240,000 for the Orillia station (CICX-FM) over a seven-year period, representing 6% of the $4 million.

Both Rogers and Larche are also requesting a licence to continue the operation of the undertaking they are acquiring under the same terms and conditions as those in effect under the current respective licence, upon surrender of the licences of CIKZ-FM currently issued to Larche (Kitchener) and CICX-FM currently issued to Rogers.
