Re:  Approach to handling certain competitor service applications

By letter dated 22 June 2007, the Commission deferred further consideration of certain applications related to competitor services pending its decision on applications made by Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), Bell Canada, Saskatchewan Telecommunications (SaskTel) and TELUS Communications Company (TCC) (the ILECs) to review and vary certain determinations in Telecom Orders CRTC 2007-20, 21, 22, 24 and 25. The Commission issued its decision with respect to these applications in Telecom Decision CRTC 2007-77 (Decision 2007-77).  

Consistent with the 14 December 2006 Policy Direction and Decision 2007-77, pending the Commission's determinations in the proceeding begun by Telecom Public Notice CRTC 2006-14, as amended (the Essential services proceeding), the Commission maintains interim approval of the services provided under the following tariff notices (TNs):

  1. Bell Aliant TN 33; [1]
  2. Bell Canada TN 7005;
  3. Persona Communications Corp. (Persona) TN 3/A;
  4. Shaw Telecom Inc. (Shaw) TN 9;
  5. Télébec TN 319A; and
  6. Vidéotron TN 15.

The Commission also maintains interim approval of the competitor Ethernet access component of [7.] Bell Aliant TN 193/193A .

Further, the Commission expects that the rates, terms and conditions for these services will not be revised on a retroactive basis.  

Further, in light of the Essential services proceeding and consistent with the 14 December 2006 Policy Direction and Decision 2007-77, the Commission will not proceed to consider further the following applications made under Part VII of the CRTC Telecommunications Rules of Procedure .   The following files are hereby closed :

  1. Rogers Communications Inc.'s ( Rogers ) application dated 3 November 2006 requesting that TCC provide a fibre-based protection service for its Competitor Digital Network (CDN) service;

  2. Bell Canada's application dated 16 March 2006 requesting the provision of CDN service in Telus Québec territory; and

  3. Bell Canada 's application dated 9 March 2006 requesting a change in the competitor service classification of TCC's Individual Line Service Asymmetric Digital Subscriber Line (ADSL) service.

The Commission notes that the effect of Decision 2007-77 is to dispose of the following Cybersurf application.   This file is also hereby closed:

  1. Cybersurf Corp.'s (Cybersurf) application dated 2 April 2007 related to certain ILECs' competitor ADSL services. [2]   

Rogers and Bell Canada are invited to resubmit their applications subsequent to the Commission's decision in the Essential services proceeding, taking into account the determinations made in that proceeding.
