Revised lists of eligible satellite services:
Addition of Canal 52 MX, Supercanal Caribe, TELEFE Internacional and TVColombia for distribution on a digital basis

  The Commission approves the request to add four non-Canadian Spanish-language general interest services to the lists of eligible satellite services for distribution on a digital basis. The revised lists including these services are set out as an appendix to Revised lists of eligible satellite services: Addition of GEO TV for distribution on a digital basis, Broadcasting Public Notice CRTC 2006-26 (Public Notice 2006-26), issued today. The revised lists appended to Public Notice 2006-26 supersede the lists appended to Revised lists of eligible satellite services, Broadcasting Public Notice CRTC 2006-15, 9 February 2006.
 

Introduction

The Commission received a request from Videotron Ltd. (Videotron) to add four non-Canadian-Spanish language services to the lists of eligible satellite services for distribution on a digital basis (the digital lists). Videotron described the services as follows:
 

Canal 52 MX is a 24-hour, general interest, Spanish-language television service. The service originates from Mexico. Its programming includes news, informal education, recreation and leisure, sports, drama, music video and general entertainment.

 

Supercanal Caribe is a 24-hour, general interest, Spanish-language television service. The service originates from the Dominican Republic, offering an average of 10 hours daily of live original programming in Spanish. Its programming includes news, religion, music, sports, sitcoms, talk shows, variety, comedy and general entertainment.

 

TELEFE Internacional is a 24-hour, general interest, Spanish-language television service. The service originates from Argentina. Its programming includes news and documentaries, sports, drama, sitcoms, music videos, music and dance, game shows and general entertainment.

 

TVColombia is a 24-hour, general interest, Spanish-language television service. The service originates from Colombia. Its programming includes news and documentaries, informal education, recreation and leisure, sports, drama, music, dance and general entertainment.

On 16 December 2005, the Commission called for comments on Videotron's request in Call for comments on the proposed addition of Canal 52 MX, Supercanal Caribe, TELEFE Internacional and TVColombia to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2005-126.
 

Positions of parties

The Commission received many comments in support of Videotron's request from community associations, business and cultural groups and individuals. Many expressed a strong interest in having access to a greater diversity of programming services in the Spanish language.
 

Commission's analysis and determination

The Commission's approach to the addition of non-Canadian third-language general interest services is set out in Improving the diversity of third-language television services - A revised approach to assessing requests to add non-Canadian third-language television services to the lists of eligible satellite services for distribution on a digital basis,Broadcasting Public Notice CRTC 2004-96, 16 December 2004 (Public Notice 2004-96). In Public Notice 2004-96, the Commission stated that, going forward, requests to add non-Canadian third-language general interest services to the digital lists would generally be approved, subject, as appropriate, to new distribution and linkage rules described in that Public Notice. In Public Notice 2004-96, the Commission also set out the information that Canadian sponsors are obliged to file in order for the Commission to consider the addition of non-Canadian third-language services to the digital lists.

The Commission has examined the information filed in support of Videotron's request, and is satisfied that the above-noted services are non-Canadian third-language general interest services.

Accordingly, consistent with the approach set out in Public Notice 2004-96, the Commission approves the addition of these four Spanish-language services to the digital lists. Canal 52 MX, Supercanal Caribe, TELEFE Internacional, and TVColombia have therefore been added to the revised lists attached to Revised lists of eligible satellite services: Addition of GEO TV for distribution on a digital basis, Broadcasting Public Notice CRTC 2006-26, also issued today. The Commission notes that the distribution of  these services is subject to the distribution and linkage rules that apply to third-language general interest services added to the digital lists after 16 December 2004, as set out in Distribution and Linkage requirements for Class 1 and Class 2 licensees, Broadcasting Public Notice CRTC 2005-119, 14 December 2005, and Linkage requirements for Direct-to-home (DTH) satellite distribution undertakings,Broadcasting Public Notice CRTC 2005-120, 14 December 2005.
