Revised lists of eligible satellite services

  The Commission approves requests to add five non-Canadian third-language general interest services to the lists of eligible satellite services for distribution on a digital basis. The four revised lists appended to this public notice supersede the lists appended to Revised lists of eligible satellite services, Broadcasting Public Notice CRTC 2006-9, 20 January 2006.
 

Introduction

The Commission received separate requests from the Canadian Cable Telecommunications Association (CCTA) to add five non-Canadian general interest third-language services to the lists of eligible satellite services for distribution on a digital basis (the digital lists). The CCTA described the services as follows:
 

Polsat 2 International is a 24-hour general interest programming service originating from Poland and offered in the Polish language. The service is targeted primarily to Polish-speaking communities outside Poland and provides a wide variety of genres of programming including reality shows, soap operas, crime series, mini-series, talk shows, documentaries, news, sports, and music programs.

 

ET-Global Channel is a 24-hour general interest programming service offered primarily in Mandarin Chinese with occasional words or phrases in Southern Fukienese. The service is targeted to Chinese-speaking people of all ages and provides a wide variety of programming including news, talk shows, game shows, dramas, variety shows and music.

 

Sahara One is a 24-hour general interest programming service originating from India and offering programming in the Hindi language. The service offers a wide variety of programming including dramas, comedies, children's shows, movies, music, game shows, talk shows and sports.

 

Indus Vision is a 24-hour general interest programming service originating from Pakistan and offering programming in the Urdu language. The service offers a wide variety of programming including dramas, sitcoms, game shows, cooking shows, talk shows, news, infotainment and children's programming.

 

GMA Pinoy TV is a 24-hour general interest programming service originating from the Philippines and offered in the Filipino language. The service is targeted primarily to Filipino migrants and overseas contract workers and provides a wide variety of genres of programming including news and public affairs, lifestyle and human interest, drama, fiction, comedy, music and variety programs.

On 25 November 2005, the Commission called for comments on the CCTA's requests in Call for comments on the proposed addition of Polsat 2 International to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2005-106, Call for comments on the proposed addition of ET-Global Channel to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2005-107, Call for comments on the proposed addition of Sahara One to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2005-108, Call for comments on the proposed addition of Indus Vision to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2005-109, and Call for comments on the proposed addition of GMA Pinoy TV to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2005-110.
 

Positions of parties

The Commission received numerous comments in support of the CCTA's requests from community associations as well as from business and cultural groups. Many expressed a strong interest in having access to a greater diversity of programming services in their own language. Videotron Ltd. also filed comments in support, submitting that the proposed services would respond to the needs of some of Canada's ethnic communities. The Commission did not receive any opposing comments.
 

Sponsor's reply

The CCTA filed a reply on 9 January 2006 in which it submitted that the level of support for the authorization of the proposed services provides a clear indication of the high level of demand for third-language services.
 

Commission's analysis and determinations

The Commission's approach to the addition of non-Canadian third-language general interest services is set out in Improving the diversity of third-language television services - A revised approach to assessing requests to add non-Canadian third-language television services to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2004-96, 16 December 2004 (Public Notice 2004-96). In Public Notice 2004-96, the Commission stated that, going forward, requests to add non-Canadian third-language general interest services to the digital lists would generally be approved, subject, as appropriate, to new distribution and linkage rules described in that Public Notice. In Public Notice 2004-96, the Commission also set out the information that Canadian sponsors would be obliged to file in order for the Commission to consider the addition of non-Canadian third-language general interest services to the digital lists.

The Commission has examined the information filed in support of these requests, and is satisfied that all of the above-noted services are non-Canadian third-language general interest services.

Accordingly, consistent with the approach set out in Public Notice 2004-96, the Commission approves the addition of the above-noted services to the digital lists. These services have therefore been added to the revised lists attached to this Public Notice. The Commission notes that the distribution of these services is subject to the distribution and linkage rules that apply to third-language general interest services added to the digital lists after 16 December 2004, as set out in Distribution and Linkage requirements for Class 1 and Class 2 licensees, Broadcasting Public Notice CRTC 2005-119, 14 December 2005, and Linkage requirements for Direct-to-home (DTH) satellite distribution undertakings, Broadcasting Public Notice CRTC 2005-120, 14 December 2005.

  - Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.
