Revised lists of eligible satellite services: Addition of GEO TV for distribution on a digital basis

  The Commission approves the request to add GEO TV, a non-Canadian third-language general interest service to the lists of eligible satellite services for distribution on a digital basis. The revised lists appended to this public notice supersede the lists appended to Revised lists of eligible satellite services, Broadcasting Public Notice CRTC 2006-15, 9 February 2006.
 

Introduction

The Commission received a request from the Canadian Cable Telecommunications Association (CCTA) to add GEO TV, a non-Canadian general interest third-language service to the lists of eligible satellite services for distribution on a digital basis (the digital lists). The CCTA described the service as follows:
 

GEO TV is a 24-hour general interest channel from Pakistan offering programming primarily in the Urdu language with less than 2% of its programming in English. GEO TV offers a wide variety of programming, including news, current affairs, infotainment, music, drama, sports and entertainment shows.

On 30 November 2005, the Commission called for comments on the CCTA's request in Call for comments on the proposed addition of GEO TV to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2005-112.

On 13 February 2006, Rogers Cable Communications Inc. (Rogers) advised that, with the wind-up of the CCTA announced on 10 February 2006, it would take over as the Canadian sponsor of GEO TV.
 

Positions of parties

The Commission received many comments in support of the request to add GEO TV to the digital lists from community associations, business and cultural groups and individuals. Many of those filing comments expressed a strong interest in having access to a greater diversity of programming services in the Urdu language. Quebecor Media Inc. also filed comments in support, submitting that the addition of non-Canadian third-language services responds to the needs of Canada's ethnic communities.
 

Sponsor's reply

The CCTA filed a reply on 18 January 2006 in which it submitted that the strong support for the addition of GEO TV to the digital lists provides a clear indication of the high level of demand for third-language services. Further, the CCTA submitted that the addition of GEO TV would expand diversity and choice in television services in Canada.
 

Commission's analysis and determination

The Commission's approach to the addition of non-Canadian third-language general interest services is set out in Improving the diversity of third-language television services - A revised approach to assessing requests to add non-Canadian third-language television services to the lists of eligible satellite services for distribution on a digital basis,Broadcasting Public Notice CRTC 2004-96, 16 December 2004 (Public Notice 2004-96). In Public Notice 2004-96, the Commission stated that, going forward, requests to add non-Canadian third-language general interest services to the digital lists would generally be approved, subject, as appropriate, to new distribution and linkage rules described in that Public Notice. In Public Notice 2004-96, the Commission also set out the information that Canadian sponsors are obliged to file in order for the Commission to consider the addition of non-Canadian third-language services to the digital lists.

The Commission has examined the information filed in support of the request, and is satisfied that GEO TV is a non-Canadian third-language general interest service.

Accordingly, consistent with the approach set out in Public Notice 2004-96, the Commission approves the addition of GEO TV to the digital lists. GEO TV has therefore been added to the revised lists attached to this Public Notice. The Commission notes that the distribution of this service is subject to the distribution and linkage rules that apply to third-language general interest services added to the digital lists after 16 December 2004, as set out in Distribution and Linkage requirements for Class 1 and Class 2 licensees,Broadcasting Public Notice CRTC 2005-119, 14 December 2005, and Linkage requirements for Direct-to-home (DTH) satellite distribution undertakings,Broadcasting Public Notice CRTC 2005-120, 14 December 2005.
