Globility Communications Corporation

Amendments to the General Tariff

The Commission received an application by Globility Communications Corporation (Globility), dated 7 November 2003, proposing revisions to its General Tariff in order to reflect the Commission's determinations in Rates for co-location floor space, Direct Connection service, Wireless Access Service: Line-side Access services, and Wireless Service Providers Enhanced Provincial 9-1-1 Network Access service, Telecom Decision CRTC 2003-12, 18 March 2003 (Decision 2003-12) and Rates for Competitor Services, Telecom Decision CRTC 2003-13, 18 March 2003, as amended by Telecom Decision CRTC 2003-13-1, 23 May 2003 and Telecom Decision CRTC 2003-13-2, 27 June 2003 (Decision 2003-13).

In addition, Globility proposed to amend the wording for item 102.8, Non-Disclosure of Confidential Information, to incorporate the Commission's determinations in Confidentiality provisions of Canadian carriers, Telecom Decision CRTC 2003-33, 30 May 2003, as amended in Telecom Decision CRTC 2003-33-1, 11 July 2003 (Decision 2003-33).

The Commission received no comments with respect to the application.
 

Commission determination

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997, the Commission determined that it was in the public interest to require competitive local exchange carriers (CLECs) to provide interconnection to all interexchange service providers and wireless service providers, at terms and conditions that are equivalent to those contained in the incumbent local exchange carriers' (ILECs') tariffs. The Commission required all CLECs to file proposed tariffs for interconnection, justifying any departure from the terms and conditions contained in the ILECs' tariffs.

In Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002, the Commission determined that all the ILECs' tariff rates would be made interim effective 1 June 2002, and that any rate changes approved by the Commission for an ILEC to meet its 2002 price cap commitment would be effective as of 1 June 2002. The ILECs' rates approved in Decisions 2003-12 and 2003-13 became effective on 1 June 2002.

The Commission notes that Globility proposed rates for Call Routing - Location Routing Number (LRN) Absent and Basic Listing Interchange File service for the provinces of Alberta and British Columbia that are inconsistent with the rates approved for TELUS Communications Inc. at 1 June 2002. The rates proposed for these services did not come into effect until 27 January 2003 and 31 March 2003, respectively. The Commission further notes that Globility has not provided any justification for its departure from the terms and conditions in the ILECs' tariffs. In the circumstances, the Commission considers that Globility should reflect the rates in effect at 1 June 2002 in its tariff.

The Commission notes that Globility proposed changes to incorporate the determinations in Decision 2003-33. In that decision, the Commission directed Canadian carriers to modify their existing tariffs, customer contracts and other arrangements to incorporate specific wording relating to the disclosure of confidential customer information.

The Commission notes that the CLECs' tariffs provide terms, conditions and rates for interconnection service for telecommunications providers. The Commission further notes that the CLEC Model Tariff specifies that the CLEC and its customer will protect each others confidential information as if it were a party to Schedule A of the master agreement for local interconnection, which provides detailed information relating to the treatment of confidential information. The Commission is satisfied that these provisions adequately address the treatment of confidential information exchanged between telecommunications providers. The Commission therefore concludes that the amendments proposed by Globility to item 102.8, Disclosure of Confidential Information, are not necessary. The Commission notes however, that the wording reflected in Decision 2003-33 should be reflected in the information that Globility provides to its end-customers and, as specified in the decision, in customer contracts.

In light of the above, the Commission approves on an interim basis, Globility's application with the exception of the proposed changes to item 102.8, Disclosure of Confidential Information and subject to the company incorporating the amendments to the rates identified below:
 
  • in item 202, Basic Listing Interchange File, replace the rate for Alberta of $0.0494 with $0.0580 and replace the rate for British Columbia of $0.0494 with $0.0432; and
 
  • in item 501, Call Routing - Local Routing Number (LRN) Absent:
 

- replace the monthly rate of $3.45 for CCS7 interconnecting circuits, two-way, with $3.20 in Alberta and with $3.75 in British Columbia;

 

- replace the monthly rate of $5.10 for line-side interconnecting circuits, in British Columbia with $6.10;

 

- replace the monthly rate of $6.10 for MF interconnecting circuits, one-way, with $5.35 in Alberta and with $6.20 in British Columbia;

 

- replace the monthly rate of $3.45 for MF interconnecting circuits, two-way, with $3.20 in Alberta and with $3.75 in British Columbia; and

 

- replace the monthly rate of $6.10 for CCS7 interconnecting circuits, one-way, with $5.35 in Alberta and with $6.20 in British Columbia.

The Commission notes that Globility's General Tariff became effective 21 October 2002. Accordingly, the rates take effect 21 October 2002. The Commission directs Globility to issue forthwith revised tariff pages reflecting the changes specified above.

The Commission further notes that in TELUS Communications Inc. - Call Routing - Location Routing Number Absent, Telecom Order CRTC 2003-50, 27 January 2003 (Order 2003-50) and in TELUS Communications Inc. - Amalgamation of the basic listing interchange file service, Telecom Order CRTC 2003-136, 31 March 2003 (Order 2003-136), the Commission approved amalgamated rates applicable to TELUS Communications Inc.'s serving territory for Call Routing - Location Routing Number Absent and Basic Listing Interchange File service, respectively.

Accordingly, the Commission directs Globility to issue tariff pages forthwith reflecting the revised rates approved in Orders 2003-50 and 2003-136 for Call Routing - Location Routing Number Absent with an effective date of 27 January 2003, and for Basic Listing Interchange File service with an effective date of 31 March 2003.
