Amendments to licences of specialty and pay television services, to reflect revised program categories

In Public Notice CRTC 1999-205, the Commission announced additions and alterations to television program category definitions. The Commission has now amended conditions of licence for the undertakings listed in the appendix to this decision, to reflect the revised program categories, set out in the appendix.

The licences of four specialty television services that had been listed in Public Notice 2000-137 have already been amended, in the context of licence renewals. Those services are WTN, Life Network, Showcase and Country Music Television (Decisions CRTC 2001-151 to 154). Amendments to the licence of a fifth undertaking, Bravo!, will be dealt with during consideration of its renewal application.

In each case where the Commission is adding Category 13 - Public Service Announcements to the licensee's nature of service, the original condition of licence authorizing the broadcast of such material is redundant and is therefore deleted.

The amended conditions of licence approved herein do not reflect any significant alteration to the existing nature of service for any of the licensees. In another decision also published today, (Decision CRTC 2001-215) the Commission has approved, in part, other related amendments.

• Theatrical feature films (subcategory 7(d) of Item 6, Schedule 1 of the Pay Television Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time) copyrighted at least five years prior to the broadcast year in which they are distributed by the Service and which, in respect of the non-Canadian titles, are predominantly mainstream theatrically released feature films that were listed within the top 100 films of Variety Magazine's annual list of top grossing films in the United States and Canada;

• Made-for-television feature films (subcategory 7(c)) copyrighted at least five years prior to the broadcast year in which they are distributed by the Service;

• Public service announcements (Category 13); and

• Filler programming (Category 15) and other programs that are feature-film-related and intended to set in context the feature film or films they accompany in the schedule.

Other programming shall be limited to programs that are feature-film-related and intended to set in context the feature film or films they accompany in the schedule.

Condition of licence 1 is amended as follows:

1. The licensee shall provide a regional, English-language general interest pay television programming service in British Columbia, Alberta, Saskatchewan, Manitoba, Yukon, the Northwest Territories and Nunavut. The service shall consist of theatrical feature films aired on TV (subcategory 7(d) of Item 6, Schedule I of the Pay Television Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time) copyrighted at least five years prior to the broadcast year in which they are distributed by the service, public service announcements (Category 13), and filler programming (Category 15).
