Amendments to licences of specialty and pay television services to reflect revised program categories; Denial of other changes proposed by licensees

In Public Notice CRTC 1999-205, the Commission set out definitions for revised program content categories, in order to cover all television programming broadcast and harmonize the three different systems used by licensees of conventional television stations, specialty television services and pay television services.

In Public Notice CRTC 2000-137, the Commission sought public comment on proposed amendments to specialty and pay television undertakings' conditions of licence to reflect the revised content categories set out in PN 1999-205. The Commission divided the licensees affected by that notice into two groups. The first group includes licensees for whom some of the proposed amendments are required to make their existing conditions consistent with the revised categories; they are dealt with in Decision CRTC 2001-214 also published today.

The second group, which is the subject of this decision, includes licensees who meet the same criteria but have also applied to either add programming categories or amend the descriptions of their nature of service in ways that would significantly change their existing conditions. The Commission is of the view that it would be more appropriate to consider such amendments in the context of licence renewals and accordingly, has denied parts of the applications that go beyond the intent of PN 2000-137. Amendments made to conditions of licence consistent with the intent of PN 2000-137, and applications for amendments which are denied, are set out in the appendix to this Decision.

The licences of four specialty television services that had been listed in Public Notice 2000-137 have already been amended, in the context of licence renewals. Those services are WTN, Life Network, Showcase and Country Music Television (Decisions CRTC 2001-151 to 154). Amendments to the licence of a fifth undertaking, Bravo!, will be dealt with during consideration of its renewal application.

The Commission notes that since it has set out a program category for Public Service Announcements (category 13), the condition of licence of each licensee listed in the appendix authorizing the broadcast of such material as advertising is no longer necessary and is therefore deleted.

Finally, the Commission notes that the amended conditions of licence approved herein do not reflect any significant alteration to the existing nature of service for any of the licensees.

Appendix to Decision CRTC 2001-215

1. LES CHAîNES TÉLÉ ASTRAL INC.
(Canal D) 2000-1386-3
The Commission approves the application to remove the phrase "other than a music video clip" (category 8(a)) from Canal D's nature of service, as music clips are now category 8(b) programming. The service will continue to broadcast programming from category 8(a).
Condition of licence 1(1) is amended as follows:
1(1) The licensee shall provide a national specialty service in the French-language with at least 90% of its programs drawn exclusively from the following categories as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:
2(a) - Analysis and interpretation
2(b) - Long-form documentary
7 - Drama and comedy
8(a) - Music and dance other than music video programs or clips

2. RADIOMUTUEL INC.
(Canal Vie) 2000-1388-9
The Commission approves the application to delete "Audience Participation Sports (formerly category 6(c)) from the list of programming categories that Canal Vie is permitted to utilize. Category 6(c) no longer exists.
Condition of licence 1 (b) is amended as follows:
1(b) The programming provided by the licensee shall be drawn exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:

Condition of licence 1 is amended as follows:
1. The licensee shall provide a national, English-language specialty service and shall draw its programs exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:
7(b) - Ongoing comedy series (sitcoms)
7(f) - Programs of comedy sketches, improvisation, unscripted works, stand-up comedy

4. 2953285 CANADA INC.
(The Discovery Channel) 2000-1357-4
The Commission denies the application to add "News" (category 1) ,"General Entertainment and Human Interest" (category 11) and "Filler Programming" (category 15) to the list of programming that The Discovery Channel is permitted to utilize.
Condition of licence 1 is amended as follows:
1(b) The programming provided by the licensee shall be drawn exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:
2(a) - Analysis and interpretation

The Commission approves the application to add "Formal Education and Pre-school" (category 5(a)) to the list of programming that The Family Channel is permitted to utilize. However, all category 5(a) programs are to be targeted to pre-school age children.
The Commission denies the application to add "Informal Education/Recreation and Leisure" (category 5(b)).
Condition of licence 3 is amended as follows:

6. HISTORY TELEVISION INC.
History Television 2000-1375-6
The Commission denies the application to add "Filler Programming" (category 15) to the list of programming that History Television is permitted to utilize.
Condition of licence 1(a) is amended as follows:
1(a) The licensee shall provide a national English-language specialty service consisting of historical documentaries, movies, mini-series and history programs which embrace both current events and past history, with a special emphasis on documentary and dramatic programs related to Canada's past. The licensee shall draw programming exclusively from the following categories as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:

7. MUSIQUEPLUS INC.
MusiMax 2000-1384-7
The Commission approves the application to delete the reference to broadcast 65% music video clips (category 8(b)) and replace it with a reference to broadcast 65% music video programs (category 8(c)), in light of the revised program categories.
Condition of licence 1(a) is amended as follows:
1(a) The licensee shall provide a national French-language specialty service designed for an adult audience that will be devoted to music in all its forms, and shall draw not less than 90% of the programming from the following categories as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:
7(d) - Theatrical feature films aired on TV
8(a) - Music and dance other than music video programs or clips
8(b) - Music video clips
8(c) - Music video programs
11 - General entertainment and human interest
12 - Interstitials
13 - Public service announcements
14 - Infomercials, promotional and corporate videos.
The licensee shall draw not less than 65% of its programs from category 8(c).
Condition of licence 8(b) is deleted since Public service announcements are now included in condition of licence 1(a).
8. THE PARTNERS OF PRIME TV
Prime TV 2000-1842-5
The Commission denies the application to add "Filler Programming" (category 15) to the list of programming that Prime TV is permitted to utilize.
Condition of licence 1(a) is amended as follows:
1(a) The licensee shall provide a national English-language specialty service consisting of programs of particular interest to adults over 50 years of age. The licensee shall draw its programs exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:

The Commission denies the application to add "Filler Programming" (category 15) to the list of programming that The Sports Network is permitted to utilize.
Condition of licence 1 is amended as follows:
1. The service provided by the licensee shall consist of programming dedicated exclusively to all aspects of sports, that is, programming covering professional and amateur sports events, sports newscasts, magazine shows, interviews, commentaries, documentaries, audience participation programs, instruction and training programs that promote physical fitness. The programming shall be drawn exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:

2(b) - Long-form documentary

The Commission denies the application to add "Game shows" (category 10) to the list of programming that Star! The Entertainment Information Station is permitted to utilize.
Condition of licence 1(a) is amended as follows:
1(a) The licensee shall provide a national, English-language specialty service whose main purpose is to inform its audience on all aspects of the entertainment industry, and shall draw its programs exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:

The Commission denies the application to add "Informal education/recreation and leisure" (category 5(b)), "Professional sports" (category 6(a)) and "Amateur sports" (category 6(b)), to the list of programming that Talk TV is permitted to utilize.
Condition of licence 1(b) is amended as follows:
1(b) The licensee shall draw its programs exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:

The Commission denies the application to add "Other drama" (category 7(g)) to the list of programming that TELETOON/TÉLÉTOON is permitted to utilize.
Condition of licence 1 is amended as follows:
1. The licensee shall provide a national specialty service with both English-language and French-language feeds.Programming shall be drawn from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:
7(d) - Theatrical feature films aired on television
7(e) - Animated television programs and films
12 - Interstitials
13 - Public service announcements
14 - Infomercials, promotional and corporate videos
15 - Filler programming.
With the exception of programs drawn from categories 12, 13, 14 and 15, a minimum of 90% of all programs shall be animated programming drawn from categories 7(d) and 7(e).

13. CHUM LIMITED
MuchMusic 2000-1356-6
The Commission approves the application to amend conditions of licence 1 and 5 of the English-language specialty television service MuchMusic.
Conditions of licence 1 and 5 are amended as follows:
1. The licensee shall provide a national, English-language specialty service consisting only of music or music-related programming, except as provided by condition of licence 5. The licensee shall draw programs exclusively from the following categories, as set out in Schedule I of the Specialty Services Regulations, 1990 and as defined in Public Notice CRTC 2000-92, as amended from time to time:
2(a) - Analysis and interpretation
2(b) - Long-form documentary
7(a) - Dramatic series
7(c) - Specials, mini-series, made-for-TV feature films
7(d) - Feature films
7(e) - Animated programming
8(a) - Music and dance other than music video programs or clips
8(b) - Music video clips
8(c) - Music video programs
11 - Human interest
12 - Interstitials
13 - Public service announcements
14 - Infomercials, promotional and corporate videos.
5. Notwithstanding condition of licence 1, the licensee shall devote no more than 5% of the broadcast week to programming from Categories 2(a) and 2(b) combined, except as individually authorized in writing by the Commission for extended coverage of special events.
Condition of licence 11(b) is deleted since Public service announcements are now included in condition of licence 1.
14. LE RÉSEAU DES SPORTS (RDS) INC.
Le Réseau des sports (RDS) 2000-1349-1
The Commission approves the application to add "Analysis and interpretation " (category 2(a)) and "Long-form documentary" (category 2(b)) to the list of programming that Le Réseau des sports is permitted to utilize.
The Commission denies the application to add "Filler Programming" (category 15) to the list of programming that Le Réseau des sports is permitted to utilize.
Condition of license 1 is amended as follows:
1. The service provided by the licensee shall consist of programming dedicated exclusively to all aspects of sports, that is, programming covering professional and amateur sports events, sports newscasts, magazine shows, interviews, commentaries, documentaries, audience participation programs, instruction and training programs that promote physical fitness.
