AMENDMENTS TO LICENCES OF SPECIALTY AND PAY SERVICES REFLECTING REVISED PROGRAM CATEGORIES |
On December 23, 1999 the Commission issued CRTC Public Notice 1999-205, Definitions for new types of priority programs; revisions to the definitions of television content categories; definitions of Canadian dramatic programs that will qualify for time credits towards priority programming requirements (the revised system). The revised system of content categories covers all programming broadcast, and harmonizes the three different systems previously used by licensees of conventional television stations, specialty television services and pay television services. |
Pay and specialty licensees typically have "nature of service" provisions that define the service as well as conditions of licence listing the categories of programming that they are permitted to broadcast. These conditions of licence currently refer to the previous program categories. |
The purpose of this public notice is to seek public comment on proposed amendments to conditions of licence necessary to reflect the new categories as well as other proposed changes by licensees. |
Under the current regulatory regime, all of the pay and specialty services listed in this notice have been permitted to broadcast public service announcements and certain interstitials. The Commission intends to permit these licensees to continue to broadcast this material by including references to the new categories 12 (Interstitials) and 13 (Public Service Announcements) in their nature of service conditions of licence, where necessary. |
In addition some licensees have previously been granted the authority to broadcast infomercials during the broadcast day (6 a.m. to midnight). The Commission intends to amend the licences of these specialty services to include a reference to the new category 14 (Infomercials) in their conditions of licence, where necessary. All pay services continue to be prohibited from broadcasting commercial messages and infomercials. |
The revised system now lists filler as category 15. Pay services (with the exception of the Family Channel) and some specialty services have the authority to use filler. The Commission intends to amend the licences of those services that require a specific reference to the new category 15 in order to continue to be authorized to broadcast filler material. |
Furthermore, the revised system has resulted in the creation of new sub-categories. Three of the program categories of the previous system have been subdivided as follows: |
Category 2: 2a) Analysis and Interpretation and 2 b) Long-form documentary; Category 6 Sports: 6a) Professional sports and 6(b) Amateur sports and Category 8 Music: 8a) Music and dance, 8b) Music video clips and 8c) Music video programs. |
In order to allow licensees to continue to broadcast the material for which they are currently authorized, the Commission intends to make the necessary amendments to refer to the appropriate new categories and sub-categories. All of these amendments would effectively maintain the status quo for these licensees. |
On 17 March 2000, the Commission published Public Notice CRTC 2000-42 entitled Certification for Canadian Programs - A Revised Approach which comes into effect on 1 September 2000. Some licensees have conditions of licence that expressly refer to the public notices that were superseded by this public notice. Accordingly, the following licensees have indicated that they would accept the replacement of those references with a reference to the Appendices to Public Notice 2000-42, as amended from time to time: |
