ISSUE NO. 1
|
|
The Commission will hold a public hearing commencing on 25 May 1999, at the Conference Centre, Phase IV, 140 Promenade du Portage, Hull, Quebec to consider applications by the Canadian Broadcasting Corporation (CBC or the Corporation) to renew the licences for the following services:
|
|
· The English and French-language radio networks;
|
|
· CBC Newsworld;
|
|
· Le Réseau de l'information;
|
|
· The English and French-language television networks; and
|
|
· CBC owned and operated television stations across Canada.
|
|
Further details on each of these applications are set out later in this notice. The Commission has asked the CBC to clarify some aspects of these applications. Responses to the Commission's inquiries will be placed on the public file when they are received. The Commission will also place on the public file, at a later date, additional information of use to parties in the preparation of their interventions. Interested parties are, therefore, encouraged and expected to monitor the content of the public examination file. They may also find all of the previous CBC licence renewal decisions mentioned in this notice on the Commission's website (www.crtc.gc.ca).

|
The Commission has recently completed public consultations in 11 locations across Canada relating to the mandate of the CBC. The transcripts of these discussions and comments filed with the Commission will form part of the public record of this proceeding. At this public hearing, the Commission will consider licence renewal applications for almost all major CBC services except the Corporation's owned and operated local radio stations. It will therefore provide an opportunity for a wide-ranging review of the role that the CBC should play in the broadcasting system as Canada moves into the new millennium.
|
|
This review will relate to the operations and priorities of the Corporation as a whole as well as to the individual applications that the CBC has submitted. It will include an in-depth review of the adequacy and appropriateness of the Corporation's plans and its ability to fulfill these plans during the next licence term. The Commission encourages all persons who wish to express their views in this proceeding to file written interventions according to the procedures set out at the end of this notice.
|
|
In order to provide a focus for this review, this document sets out a brief overview of the broadcasting environment in which the CBC currently operates. It then identifies some of the major issues that the Commission wishes to explore. The Commission may also review other issues at the hearing. Interested parties may, therefore, also comment in their interventions on any other issues relevant to the applications and CBC's role in the broadcasting system.

BROADCASTING ENVIRONMENT
|
|
Since the Commission last considered licence renewal applications by the CBC for its radio and television services in 1993 and 1994 respectively, the broadcasting environment has become much more fragmented.
|
|
In addition to conventional television networks and stations, the Commission has licensed 43 Canadian specialty services as well as six Canadian pay television services and five Canadian pay-per-view services that soon will compete for the attention of viewers. Recently licensed pay audio services may provide additional competition for conventional radio stations. The move by distributors to digital technology and the establishment of alternative distributors such as direct-to-home (DTH) systems and multipoint distribution systems (MDS), may lead to the opportunity for even more programming choices. The CBC, as the national public broadcaster, will be implementing its mandate, in its next licence term, in a more fragmented and competitive marketplace.
|
|
In Decision CRTC 94-437 renewing the licences of the CBC's television networks, the Commission noted that in an increasingly competitive environment, "...the need may be greater than ever for an outlet to express truly Canadian stories, ideas and values amid these foreign voices. A strong Canadian national public broadcaster is indispensable in this context. What Canadians require and expect of their CBC, more than of any other Canadian broadcaster, is that it provide the means for them to talk to one another about things Canadian, both formally and informally, that it be a place where they can feel at home."
|
|
Many of those participating in the public consultations expressed similar views, particularly with respect to CBC radio.
|
|
REGULATORY ENVIRONMENT
|
|
The Commission is in the midst of several important reviews, including broad reviews of its television, campus and community radio and ethnic broadcasting policies. It is also exploring issues related to new media and has issued a call for comments on an appropriate framework for licensing new pay and specialty services. The Commission announced its new policy for commercial radio in Public Notice CRTC 1998-41.
|
|
In Public Notice CRTC 1997-105, the Commission indicated that it would consider issues related to CBC Radio at the time of the licence renewal for the Corporation's four radio networks. This hearing will therefore provide an opportunity, in detail, to review the appropriate regulatory approach to CBC radio. It will also serve as a forum to consider the Corporation's overall role in light of the Commission's evolving approach to other sectors of the broadcasting system.
|
|
STATUTORY MANDATE
|
|
The Broadcasting Act (the Act) sets out the following specific mandate for the CBC in section 3(1):
|
|
(l) the Canadian Broadcasting Corporation, as the national public broadcaster, should provide radio and television services incorporating a wide range of programming that informs, enlightens and entertains;
|
|
(m) the programming provided by the Corporation should
|
|
(i) be predominantly and distinctively Canadian,
|
|
(ii) reflect Canada and its regions to national and regional audiences, while serving
the special needs of those regions, |
|
(iii) actively contribute to the flow and exchange of cultural expression,
|
|
(iv) be in English and in French, reflecting the different needs and circumstances of
each official language community, including the particular needs and circumstances of English and French linguistic minorities, |
|
(v) strive to be of equivalent quality in English and in French,
|
|
(vi) contribute to shared national consciousness and identity,
|
|
(vii) be made available throughout Canada by the most appropriate and efficient
means and as resources become available for the purpose, and |
|
(viii) reflect the multicultural and multiracial nature of Canada;
|
|
(n) where any conflict arises between the objectives of the Corporation set out in paragraphs (l) and (m) and the interest of any broadcasting undertaking of the Canadian broadcasting system, it shall be resolved in the public interest, and where the public interest would be equally served by resolving the conflict in favour of either, it shall be resolved in favour of the objectives set out in paragraphs (l) and (m).
|
|
Issues - Corporate strategy and mandate
|
|
The Commission wishes to review the following issues related to the Corporation's strategy to implement the mandate set out above:
|
|
· The CBC's proposed strategy for implementing its mandate through its radio and television services, including specialty services.
|
|
· The Corporation's specific plans for serving the public on a regional as well as on a national level.
|
|
· The CBC's role in relation to that of private broadcasters in radio, television and specialty services. How should the programming provided by CBC services differ from the programming that private broadcasters provide?
|
|
· The CBC's overall approach and specific plans for the presentation and funding of Canadian programming, as well as for attracting audiences to Canadian programming.
|
|
· The implications of the CBC's concept of constellations of services, including its plans for new media, on the Corporation's licensed services being examined at this hearing.
|
|
· The ways in which the Corporation establishes both operating and capital budgets for each of its media and media support services.
|
|
· The decision-making process, including the criteria that the CBC uses to determine which initiatives competing for limited resources will be funded.
|
|
· How the Corporation allocates or otherwise distributes funding streams, such as government appropriations, advertising and subscription revenues, among its various services.
|
|
· The rationale used by the CBC for allocating certain cost elements in the determination of its programming expenses.
|
|
· The Corporation's approach to initiatives involving partnerships with other parties, particularly other broadcasters and independent producers.
|
|
THE CBC RADIO NETWORKS
|
|
The Commission renewed the licences for the CBC's two English-language and two French-language radio networks until 31 March 2000 in Decision CRTC 93-95. The licences were extended until 31 August 2000 in Decision CRTC 99-27, subject to the same terms and conditions. These extensions were granted so that the expiry dates would coincide with those of the other CBC licences whose renewals are being considered at this hearing.
|
|
Decision 93-95 set out conditions of licence for each network. These included conditions to preserve the essentially non-commercial nature of the CBC radio and to ensure high levels of Canadian music.
|
|
Each CBC radio network must ensure that at least 50% of general popular (category 2) musical selections and at least 20% of traditional and special interest (category 3) musical selections played each week are Canadian.
|
|
The decision also included expectations related to the technical coverage of CBC radio services and the special needs of francophones living outside Quebec.
|
|
In Public Notice CRTC 1997-105 An agenda for reviewing the Commission's policy for radio, the Commission indicated that it would explore issues related to CBC radio at this hearing.
|
|
Issues - CBC Radio Networks
|
|
· The appropriate regulatory framework for CBC radio.
|
|
· The Corporation's compliance with the conditions of licence and expectations set out in Decision 93-95, as well as its specific plans to address the areas covered by the conditions of licence and expectations in the new licence term. The Commission will wish to discuss, among other things, the apparent non-compliance of the English-language Radio network (Radio 1), the French-language Radio Network (la Première chaîne) and the French-language Stereo Network (la Chaîne culturelle) with conditions of licence related to minimum levels of Canadian music in category 2. The Commission will also wish to review an apparent shortfall in the level of French-language vocal music played by both French-language networks, compared with commitments made during the 1993 licence renewal.
|
|
· The Corporation's proposal to reduce the weekly minimum level of French-language vocal music in content category 2 (popular music) on its French-language radio networks from 95% to 85%.
|
|
· The Corporation's proposal to amend conditions of licence for its four radio networks to allow it to broadcast short, simple announcements to acknowledge partners and sponsors.
|
|
· The type and amount of regional programming broadcast, and how material produced in the various regions is integrated into network programming.
|
|
· Plans with respect to broadcasting music composed by Canadians on Radio 2 and La Chaîne culturelle.
|
|
· The Corporation's plans with respect to the development and promotion of Canadian musical and other artistic talent.
|
|
· The implications on the existing radio services of the CBC's proposals to establish new radio networks.
|
|
· The Corporation's plans for digital radio broadcasting.
|
|
CBC NEWSWORLD AND LE RÉSEAU DE L'INFORMATION
|
|
The Commission renewed the licence for the English-language specialty service CBC Newsworld until 31 August 1999 in Decision CRTC 92-529. A licence for the French-language specialty service le Réseau de l'information (RDI) was granted in Decision CRTC 94-285, also with an expiry date of 31 August 1999. The Commission extended the licences for both these services until 31 August 2000 in Decision CRTC 99-26.
|
|
Decisions 92-529 and 94-285 set out conditions of licence for each service. These include conditions designed to ensure that, among other things, the services provide a programming schedule oriented to news and information programming and meet Canadian content levels of at least 90%.
|
|
Issues - CBC Newsworld and RDI
|
|
· The types of programming best suited for broadcast on these services.
|
|
· The amount and types of programming from the Corporation's TV networks that would be appropriate for broadcast, either simultaneously or otherwise, on the specialty services.
|
|
· The Corporation's proposal to amend its conditions of licence to increase its maximum wholesale rates.
|
|
· RDI's proposal to lower its Canadian content requirement.
|
|
THE CBC TELEVISION NETWORKS
|
|
The Commission renewed the licences for the CBC's English-language and French-language television networks until 1 September 1999 in Decision CRTC 94-437. The licences were extended until 31 August 2000 in Decision CRTC 99-26, subject to the same terms and conditions.
|
|
Decision 94-437 included specific expectations in 18 areas, both for the long term and the current licence term.
|
|
These expectations relate to the following areas for both networks: Canadian content, programming for children and youth, drama, regional production, programming exchange between networks, performing arts, use of independent production, Canadian musical talent, diversification of sources of foreign content, violence in programming, portrayal of women, multicultural representation, captioning of programs, portrayal of native Canadians and extension of service.
|
|
The decision also included special expectations for the French-language television network in the areas of weekend news and information and reflection of the needs of French-speaking Canadians living outside of Quebec.
|
|
An additional set of expectations dealt with service to Canada's north.
|
|
Decision 94-437 also encouraged the CBC television networks in a number of areas. These related to advertising practices, development of alternative sources of revenue, replacement of some professional sports programming on the English-language network, and the diversification of the programming schedule of the English-language network.
|
|
In Decision CRTC 98-107 the Commission renewed the licence for CBVT-TV, Quebec City until 31 August 2003. In the decision, the Commission noted that some of the issues raised in the context of that renewal had substantial implications and should be addressed in the context of the licence renewal for the CBC's French-language television network. These issues included the following:
|
|
· The scope of collaboration with the network on local programming produced in Québec or elsewhere in the province for network broadcast.
|
|
· The extent of the flexibility provided by network availabilities to permit affiliates to break away for the broadcast of local programming.
|
|
· The availability of prime time segments to broadcast local programming other than news in the regions.
|
|
· Programming exchanges between CBVT and RDI.
|
|
· The special role of CBVT in serving Eastern Quebec.
|
|
· The implications of regional independent production on the network's production activities.
|
|
· Evaluation of the system put in place by the CBC to consider proposals by independent producers.
|
|
· The scope of contributions and commitments to, and a report on the development of different methods of, closed captioning for persons who are deaf or hard of hearing, including the CBC's commitment to implement live captioning of all regional Ce Soir programs by 2000.
|
|
Issues - Television Networks
|
|
· The CBC's programming principles and priorities in light of its anticipated financial resources and a more competitive broadcasting environment.
|
|
· How the Corporation has met each of the conditions of licence and expectations set out in Decision 94-437 and how it intends to address the areas covered by these conditions of licence and expectations during the upcoming licence term.
|
|
· The Corporation's strategy and specific plans for increasing the amount of Canadian programming it broadcasts, both over the broadcast day and in the evening.
|
|
· How the programming offered by CBC television reflects Canada's regions to national and regional audiences.
|
|
· How the programming offered by CBC television contributes to the diversity of programming available in the Canadian broadcasting system.
|
|
· The extent to which advertising on CBC television services may influence decisions related to programming in both the information and entertainment categories.
|
|
· The emphasis that the public broadcaster places on high profile commercial sports programming, and the impact that this may have on its ability to fulfill other aspects of its mandate.
|
|
· The Corporation's policies and practices with respect to the acquisition and use of programming produced by Canadian independent producers.
|
|
· The impact of the government's decision to remove the CBC's guaranteed access to a portion of the Canadian Television Fund on the Corporation's ability to acquire programming from Canadian independent producers.
|
|
· Issues related to the French-language television network identified in Decision 98-107, as set out in the previous section.
|
|
· The Corporation's plans to introduce technical advancements such as stereo sound and digital television.
|
|
CBC OWNED AND OPERATED REGIONAL TELEVISION STATIONS
|
|
This hearing will include consideration of licence renewal applications for all of the CBC's originating television stations except CBVT-TV Quebec City. As indicated earlier, CBVT's licence was renewed until 31 August 2003 in Decision CRTC 98-107. The licences for all the other CBC regional television stations expire on 31 August 2000. Details concerning the renewals of each of these stations are set out later in this notice.
|
|
Issues - Regional Television Stations
|
|
· How the CBC has implemented conditions of licence and expectations set out in the previous licence renewal decisions, and how it proposes to address the areas covered by these conditions of licence and expectations in the next licence term. The Commission will wish to discuss, among other things, the Corporation's apparent shortfall compared with its local/regional news commitments at most of its English-language and some of its French-language originating stations.
|
|
· For each regional station, the level of local news and other programming reflecting its region that the Corporation proposes to broadcast over the next licence term.
|
|
· The extent to which each CBC station will contribute programming to the network.
|
|
· The regional resources that will be devoted to the production and acquisition of Canadian programming.
|
|
· The extent to which the CBC stations will broadcast programming produced by regional independent producers.
|
|
1. ACROSS CANADA
|
|
Applications (199901799, 199901830, 199901822, 199901848) by the CANADIAN BROADCASTING CORPORATION to renew the broadcasting licences to carry on its AM and FM French and English language radio networks expiring 31 August 2000.
|
|
The Corporation proposes an amendment to the condition of licence imposed on its French and English-language radio networks with respect to commercial activity (Decision CRTC 93-95, page 4). This condition of licence restricts CBC from broadcasting commercial messages (category 5), with the exceptions set out in the above-mentioned decision.
|
|
The Corporation requests permission to broadcast short, simple announcements intended to identify partners and sponsors. According to CBC, these announcements may incorporate the name and address of the partner or sponsor, as well as a brief description of the products and services offered by the partner or sponsor, but without promoting these products and services. These announcements could include on-air promotion of events, products and services offered to the public by the CBC, either alone or in partnership with other parties. They could also include on-air promotion of other cultural and community events accompanied by the identification of a sponsor.

2. ACROSS CANADA
|
|
Application (199813598) by the CANADIAN BROADCASTING CORPORATION (NEWSWORLD) to renew the specialty programming undertaking licence to provide a national English-language news and information service expiring 31 August 2000.
|
|
1. The licensee proposes to amend condition of licence no. 5 by increasing its maximum monthly wholesale rate per subscriber from $0.55 to $0.63 effective 1 January 2000.
|
|
2. The licensee proposes to amend condition of licence no. 6 to read:
|
|
The licensee shall ensure that a minimum of 75% of all programming distributed on the service is either closed captioned or signed. Commencing 1 September 2002 and for the remainder of the licence term, the licensee shall ensure that a minimum of 90% of all programming distributed on the service is either closed captioned or signed.
|
|
3. The licensee proposes to amend conditions of licence no. 7 and 8 pertaining to the amount of financial information submitted by Newsworld to the Commission each year.
|

4. The licensee proposes to remove condition of licence no. 9 which requires the licensee to file with the Commission, on or before 30 June in each year, a statement of the accounts referred to in condition of licence no. 8

1. The licensee proposes to amend condition of licence no. 2 by lowering its Canadian content requirement per subscriber from 90% to 85%.
