Public Notice CRTC 1999-166
REVISED LISTS OF ELIGIBLE SATELLITE SERVICES
1.  In Decision CRTC 99-455dated 5 October 1999, the Commission approved an application by Star Choice Television Network Incorporated (Star Choice), to amend the broadcasting licence for the national satellite relay distribution undertaking (SRDU), by adding certain Canadian television services to the list of signals that it is authorized to distribute. The List of Part 3 Eligible Satellite Services (Part 3 list) appended to this notice as Appendix B has been amended accordingly.
Addition of Canadian services
2.  Star Choice has been authorized to distribute three additional services that do not currently appear on the Part 3 list. These are: CJCB-TV (CTV) Sydney, CKLT-TV (CTV) Saint John and CKAL-TV (IND) Calgary.
3.  The Commission notes that the distribution of the CTV signals by cable licensees is subject to a restriction which requires that, where a cable licensee is also distributing the signal of a local CTV affiliate, it shall delete the duplicate programming received from the licensed SRDU or substitute the local service when the programming is identical.
Change of affiliation of KIRO-TV Seattle and KSTW Tacoma/Seattle
4.  In Decision CRTC 99-456of today’s date, the Commission approved an application by Canadian Satellite Communications Inc. (Cancom), to amend the licence for its SRDU, by changing the affiliation of two U.S. stations that it is authorized to distribute.
5.  As a result of a reorganization, two U.S. stations that Cancom is authorized to distribute have changed affiliations. KIRO-TV Seattle, formerly listed as an independent station, is now a CBS affiliate, and KSTW Tacoma/Seattle, formerly listed as a CBS affiliate, is now an independent station.
6.  The List of Part 2 Eligible Satellite Services (Part 2 list) and the Part 3 list appended to this notice have been amended accordingly.
7.  The Commission notes that a corresponding change to the List of DTH Eligible Satellite Services (DTH list) is required. Specifically, KIRO-TV (IND) Seattle, which appears in Section B of the DTH list, is replaced by KSTW (IND) Tacoma/Seattle.
8.  For the purposes of the DTH list, KSTW will be identified as a "U.S. superstation". As noted in Public Notice CRTC 1997-50 dated 2 May 1997, this identification will permit DTH licensees to designate and subsequently distribute this signal in a discretionary package that may include one or more Canadian specialty and/or pay television services.
Addition of Radio France outre-mer (RFO1)
9.  In Public Notice CRTC 1999-138 dated 24 August 1999, the Commission announced a request by Bell Satellite Services Inc. (BSSI), doing business under the name of Bell ExpressVu, to add Radio France outre-mer (RFO1) Saint Pierre and Miquelon, to the DTH list. The Commission notes that it received one intervention in support of BSSI’s request.
10.  In Decision CRTC 98-18 dated 30 January 1998, the Commission authorized the addition of the RFO1 service to the Part 2 list (Section A) and to the Part 3 list (Public Notice CRTC 1998-7).
11.  The DTH list appended to this notice as Appendix C has been amended accordingly.
Revised lists
12.  The above-mentioned lists supersede the lists appended to Public Notice CRTC 1999-65 dated 19 April 1999.
Other matters
13.  Class 1 and Class 2 licensees are reminded that, in accordance with the Distribution and Linkage Requirements for Class 1 and Class 2 licensees (Public Notice CRTC 1999-90 dated 21 May 1999), a condition of licence is required in order to distribute signals appearing on the Part 2 list, as part of the basic service.

-  In the case of signals received from a licensed SRDU, ASN, the CBC English- and French-language Television Services and U.S. satellite services, licensees are required to enter into the necessary contractual arrangements for such carriage.
-  Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.
