Decision

Ottawa, 31 March 1998

Decision CRTC 98-94

Fundy Cable Ltd./Ltée

Brown's Flat; Morrisdale; Musquash Subdivision; Welsford; Willow Grove and Garnett Settlement, New Brunswick - 199709052 - 199709044 - 199715489 - 199715497 - 199715505

Licence amendments

1. In Public Notice CRTC 1998-9 dated 6 February 1998, the Commission announced applications by Fundy Cable Ltd./Ltée (Fundy) to amend the broadcasting licences for the Class 3 cable distribution undertakings serving the above noted communities by, among other things, deleting the local head end of the undertakings and interconnecting these undertakings, via optical fibre, to the Class 1 cable distribution undertaking serving Saint John, also owned by the licensee.

2. The Commission notes that, in Public Notice CRTC 1997-25 dated 11 March 1997, it confirmed its intention to eliminate the requirement that cable licensees own, among other things, their local head end. The Broadcasting Distribution Regulations which came into effect on 1 January 1998 do not impose this requirement. Therefore, approval of that part of the applications is no longer required.

3. In view of the above-noted interconnections, the licensee is authorized to distribute the signals of WLBZ-TV (NBC) Bangor, WMEM-TV (PBS) Presque Isle, Maine and CFTF-TV-1 (TQS) Edmundston, as part of the basic service.

4. The licensee is authorized to receive the signals over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings. The Commission notes that Fundy plans to receive the above authorized signals by optical fibre.

This decision is to be appended to each licence.
