Interconnections and licence amendments

Following Public Notice CRTC 1997-9 dated 20 January 1997, the Commission approves the applications for authority to delete the local head end of the cable distribution undertaking serving Thurso and to interconnect, via optical fibre, this undertaking, as well as the undertakings serving Montebello and Saint-André-Avellin which are already interconnected, to the cable distribution undertaking serving Buckingham, also owned by the licensee.

In approving these interconnections, the Commission has taken into consideration the fact that subscribers of these undertakings will now have access to an extended basic service and to a greater number of discretionary services.

The Commission approves the licensee's request for authority to distribute CFCF-TV (CTV) Montréal, CHRO-TV (CTV) Pembroke and CFMT-TV-2 (IND) Ottawa, received via optical fibre, as part of the basic service of each undertaking.

The distribution of these services is consistent with the guidelines for the cable distribution of distant Canadian television signals first set out in Public Notice CRTC 1985-61 and reiterated in Public Notice CRTC 1993-74.

The licensee is also authorized to distribute WNPE-TV (PBS) Watertown, WOKR-TV (ABC), WHEC-TV (NBC) and WROC-TV (CBS) Rochester, New York, received via optical fibre, as part of the basic service of each undertaking.

The licensee is further authorized to distribute WUTV (FOX) Buffalo, New York, received via optical fibre, on a discretionary tier of each undertaking.

In view of the interconnections authorized herein, approval to distribute these U.S. signals is consistent with the authority granted to the licensee in Decisions CRTC 94-795 dated 4 October 1994 and 93-54 dated 15 February 1993, with respect to its undertaking serving Buckingham.

The Commission also approves the licensee's request with respect to section 23 of the regulations. Accordingly, it is a condition of each licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the Cable Television Regulations, 1986, so long as it distributes only those U.S. television services listed in the current applications or as may be authorized by the Commission.

In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence amendments, and the authority will only be granted, at such time as written notification is received from the the Department of Industry that it will issue Broadcasting Certificates.

The Commission acknowledges the intervention received in support of the applications for interconnection.

This decision is to be appended to each licence.
