Deletion of local head end, interconnection and licence amendments
Following Public Notice CRTC 1996-81 dated 12 June 1996, the Commission approves the application by Regional Cable TV (Central) Inc. for authority to delete the local head end of the cable distribution undertaking serving Sainte-Pétronille and to interconnect this undertaking with its undertaking serving Saint-Joachim-de-Montmorency.
The licensee indicated that approval of this application will allow it to fulfill the commitments made following a Public Hearing held on 4 May 1993 with respect to the reinstatement of the programming services that were distributed prior to 1 September 1992.
In this regard, the licensee is authorized to distribute, as part of the basic service of the undertaking serving Sainte-Pétronille, the community channel of Beaupré and Télémag 24, received via microwave from Saint-Joachim-de-Montmorency.
The licensee also indicated that the priority local signal of CKMI-TV (CBC) will again be available on Île d'Orléans (Sainte-Pétronille) following the proposed interconnection.
With respect to the undertaking serving Saint-Joachim-de-Montmorency, the Commission notes that the licensee was relieved in Decision CRTC 93-451 dated 20 August 1993 of the requirement of section 23 of the Cable Television Regulations, 1986 (the regulations) so long as it distributed only those U.S. television services listed in the application or as might be authorized by the Commission.
As part of the current application, the licensee requested authority to add the distribution of WUHF-TV (FOX) Rochester, New York, CNN Headline News (CNN-2) and The Arts and Entertainment Network (A&E), as part of the basic service of the undertaking serving Saint-Joachim-de-Montmorency.
The Commission approves the licensee's request to add the above-noted U.S. services. The Commission is satisfied that approval of this request is consistent with the regulations which require cable licensees to devote, in total, more channels to the distribution of Canadian programming services than to non-Canadian programming services. In approving this request, the Commission has also noted that the licensee has taken into consideration the needs and wishes of its subscribers.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence amendment, and the authority will only be granted, at such time as written notification is received from the the Department of Industry that it will issue a Broadcasting Certificate.
This decision is to be appended to each licence.
