Licence renewal
Following Public Notice CRTC 1994-146 dated 2 December 1994, the Commission renews the licence held by Cogeco Câble Canada Inc., for the cable distribution undertaking serving Notre-Dame-du-Bon-Conseil, from 1 September 1995 to 31 August 2001.
The licence term granted herein, while less than the maximum of seven years permitted by the Broadcasting Act (the Act), will enable the Commission to consider the next licence renewal of this undertaking in accordance with the Commission's regional plan and to better distribute the workload within the Commission. This term is not reflective of any Commission concern regarding the licensee's performance.
The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute CFTM-TV (TVA), CFCF-TV (CTV) and CBFT (CBC) Montréal, CFKS-TV (TQS) Sherbrooke as well as WVNY-TV (ABC), WCAX-TV (CBS) and WETK (PBS) Burlington, Vermont and WPTZ (NBC) Plattsburgh, New York, received by optical fibre, as part of the basic service.
The Commission approves, by condition of licence, the licensee's request to be relieved from the requirement of paragraph 22(1)(a) of the regulations that it distribute local services CHEM-TV (TVA) and CIVC-TV (SRTQ) Trois-Rivières. The licensee explained that the undertaking's head end is located at Gallup Hill; the Sherbrooke signals are received via microwave from Gallup Hill to Drummondville and via optical fibre from Drummondville to Notre-Dame-du-Bon-Conseil. The licensee added that distribution of signals from Trois-Rivières would entail very high costs per subscriber. The licensee proposes to distribute instead the regional signals of CHLT-TV (TVA) and CIVS-TV (SRTQ) Sherbrooke, received by optical fibre.
The Commission approves, by condition of licence, the licensee's request to be relieved, for the reasons noted above, from the requirement of subsection 22(1) of the regulations that it distribute the local signal CKTM-TV (CBC) Trois-Rivières on the basic band. The Commission notes that the licensee will distribute this signal on channel 18, and will distribute the signal of CKSH-TV (CBC) Sherbrooke, a regional signal, on channel 13 of the basic band.
Consistent with Decision CRTC 90-1156, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only those U.S. television services listed in the current application or as may be authorized by the Commission.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
The Department of Industry has advised the Commission that it is prepared to renew the Broadcasting Certificate for a period of five years only, expiring 31 August 2000. With respect to the operation of this undertaking beyond this period, the Commission draws the licensee's attention to subsection 22(1) of the Act pertaining to the technical certification of broadcasting undertakings and to subsection 22(4) which provides that any broadcasting licence issued, amended or renewed in contravention of section 22 is of no force or effect.
