b) to amend the Promise of Performance by decreasing the level of news to 1 hour 30 minutes weekly; and
c) to add conditions of licence to broadcast a weekly minimum Spoken Word level of 5% and a weekly minimum of 10% Canadian content regarding category 2 music.
The proposal in paragraph b) entails an exemption from the Commission's FM policy requiring the broadcast of at least 3 hours of news per week as outlined in Public Notice CRTC 1990-111 entitled "An FM Policy for the Nineties".
The licensee also proposes to maintain the commitments in its Promise of Performance of a playlist of at least 300 distinct musical selections, a maximum repeat factor of 42 and a maximum hit level of 95%. These proposals entail exemptions to the FM policy requiring a weekly music list of at least 850 distinct musical selections, a maximum repeat factor of 18 and a hit level of less than 50% of all popular music selections.
With respect to paragraph c) sections 13 and 2.2 of the radio regulations, 1988 require a minimum of 15% Spoken Word and a minimum of 30% Canadian content with respect to category 2 music, as outlined in Public Notice CRTC 1991-89 entitled "Amendments to the Radio Regulations, 1986", except as otherwise provided pursuant to a condition of licence.
In CRTC Public Notice CRTC 1991-121 dated 22 November 1991, the Commission gazetted an application by CKLW-FM to add a condition of licence to broadcast a weekly minimum of 12% Canadian content with respect to category 2 music and 10% Canadian content with respect to category 3 music.
The applicant is seeking flexibility in these areas to enable it to better compete with the U.S. signals available in the Windsor market.

28. ACROSS CANADA
Application (912835600) by the CANADIAN BROADCASTING CORPORATION (CBC Newsworld) to renew the specialty programming undertaking licence to provide a national English-language news and information service expiring 31 August 1992. The applicant proposes to amend certain conditions of licence as follows:
|
|
CONDITION 4.
Current:
a) The licensee shall distribute no more than 8 minutes of advertising material during each clock hour.
b) The licensee shall not distribute any advertising material other than national advertising.
Proposed:
a) The licensee shall distribute not more than 8 minutes of national advertising material during each clock hour. In addition, thelicensee may broadcast a maximum of one minute of advertising material consisting of unpaid public service announcements during any clock hour when all 8 minutes are sold out.
b) For the purpose of this condition of licence, program promotions for Newsworld's Canadian programs shall not count as advertising material.
c) Subject to a) above, should the 8 minutes of advertising material authorized for any clock hour be pre-empted by long-form live programming which is broadcast without commercial messages, the licensee may schedule up to 10 minutes of advertising material per clock hour in other hours of the same broadcast day, so long as the aggregate amount of advertising material does not exceed 168 minutes in that broadcast day.

CONDITION 5.
Current:
Newsworld's condition of licence respecting wholesale rates is based on a sliding scale, determined by the number of subscribers. The current wholesale rate is $0.32 per subscriber per month.
Proposed:
Based on its subscriber projections, Newsworld is proposing the following wholesale rates in anglophone markets for the next licence term:
September 1992 $0.59
September 1993 $0.61
September 1994 $0.63
September 1995 $0.65
September 1996 $0.67
September 1997 $0.695
September 1998 $0.72 For francophone markets, Newsworld is proposing to increase the wholesale rate from the current $0.10 to $0.185 effective September 1992, with annual inflationary increases each year thereafter.

CONDITION 10.
Current:
The licensee shall file with the Commission by 30 November of each year a report for the broadcast year or part thereof completed on the preceding 31 August identifying separately each of the types of incremental costs incurred as a result of providing the news and information service, with a detailed breakout, based on the cost separation accounting procedures filed with the Commission as part of this application.

CONDITION 11. (as amended by Decision CRTC 89-831)
Current:
The licensee shall file with the Commission by 30 June of each fiscal year the results of an audit carried out by an independent outside auditor for the fiscal year or part thereof ending the preceding 31 March, certifying that the news and information service is recovering fully the incremental costs incurred as a result of provision of the service and that funds paid to the Corporation out of parliamentary appropriations are not being spent for the purpose of recovering these incremental costs.
The audit report shall also certify that appropriate accounts have been maintained in respect of advertising revenue earned by the news and information service and that advertising revenue derived from joint sales by the news and information service and the existing radio and television services of the Corporation have been allocated between the news and information service and existing CBC services.
The licensee shall also file with the Commission unaudited financial statements for each twelve-month period ending 31 August. CBC management shall certify that these financial statements have been reviewed in accordance with section 8200 of the Canadian Institute of Chartered Accountants Handbook.
Proposed:
The licensee proposes to replace conditions of licence 10 and 11 with a new condition of licence for the next licence term whereby the incremental revenues and incremental costs incurred by CBC Newsworld would be reported within the notes to the Corporation's financial statements at the end of each fiscal period. Thus, the amounts would be audited by the Auditor General of Canada within the scope of the Corporate Audit.

Application (912827300) by YTV CANADA INC. to renew the specialty programming undertaking licence to provide a national English-language children, youth and family-oriented service expiring 31 August 1992. The applicant proposes to amend certain conditions of licence as follows:

CONDITION 2.
Current:
The licensee shall devote 100% of the programs in the drama category distributed in the evening broadcast period to programs with a major protagonist that is a child, youth under the age of 18 years, puppet, animated character or creature of the animal kingdom.
Proposed:
The licensee shall devote 100% of the programs in the drama category distributed in the evening broadcast period to programs with a major protagonist that is:
- a child;
- youth under the age of 21 years;
- puppet;
- animated character;
- creature of the animal kingdom, or
- folk, comic book, and/or super heroes.

CONDITION 5.
Current:
In any evening broadcast period, the licensee shall distribute no more than one hour (non-cumulative) of drama programs produced in the United States, excluding feature films.Proposed:
During the evening broadcast period, the licensee shall distribute, on a weekly basis, no more than seven hours, with a maximum of two hours per day, of drama programs produced in the United States, excluding feature films and animated television programs or films.

CONDITION 6 c).
Current:
All feature films distributed on YTV shall have received from the Ontario Film Review Board a classification of "Family" or "Parental Guidance" or equivalent.
Proposed:
All feature films distributed on YTV shall have received as available from the Ontario Film Review Board a classification of "Family" or "Parental Guidance" or equivalent.

CONDITION 9.
Current:
In the first year of operation, the programming distributed by the licensee shall include a minimum of 40 hours of original, first-run Canadian programs, increasing to a minimum of 55 hours of original, first-run Canadian programs during the third year of operation.
For the purpose of this condition, an original, first-run program means a program which has never before been distributed by any licensee of a broadcasting undertaking and which will be distributed for the first time by the licensee.
Proposed:
In the first year of the new licence term, the programming distributed bythe licensee shall include a minimum of 60 hours of original, first-run Canadian programs, increasing to a minimum of 90 hours of original, first-run Canadian programs during the last year of the seven-year term.
For the purpose of this condition, an original, first-run program means a program which has never before been distributed on a national basis by any licensee of a television programming undertaking and which will be distributed for the first time by the licensee.

CONDITION 11.
Current:
YTV's current condition of licence specifies that the licensee charge each exhibitor of its service a wholesale rate of $0.32 per subscriber per month.
The licensee is also currently authorized to charge each exhibitor of its service in the Province of Quebec a wholesale rate of $0.08 per subscriber per month.
Proposed:
The licensee shall charge each exhibitor of the YTV service a wholesale rate per month according to the following schedule:
From 1st September 1992 to
31 December 1992 $0.32
From 1st January 1993 to
31 December 1993 $0.33
From 1st January 1994 to
31 December 1994 $0.34
From 1st January 1995 to
31 December 1995 $0.35
From 1st January 1996 to

CONDITION 12 a).
Current:
Subject to (b) and (c), the licensee shall distribute no more than 8 minutes of advertising material during each clock hour.
Proposed:
Subject to (b) and (c), the licensee shall distribute per clock hour during each broadcast day no more than 8 minutes of commercial messages and no more than 4 minutes of unpaid public service announcements and promotional announcements for Canadian programs.

CONDITION 15.
Current:
In each broadcast year, the licensee shall devote not less than 10% of the annual gross revenues derived from the operation of this service to investment in the development and production of original first-run Canadian programs, and not less than 20% of its annual gross revenues to the licensing of Canadian programs.
Proposed:
In each broadcast year, the licensee shall expend not less than 35% of theannual gross revenues derived from the operation of this service in the preceding year to acquiring and investing in Canadian programs. Of this amount, no less than one-third must be allocated to the development, production and licensing of original, first-run Canadian programs.
