Preamble

On 15 March 2024, the Commission published Broadcasting Notice of Consultation 2024-60 calling for interested persons to submit an application for a broadcasting licence to operate a new radio station to serve Calgary, Alberta. In that call, the Commission found that the Calgary market has the capacity to sustain at least one additional radio station. In the Commission’s preliminary view, the market may be best served by proposals for stations to serve ethnic and Indigenous communities. Therefore, the Commission encouraged interested persons to submit an application for a broadcasting licence to operate an ethnic or Indigenous radio station but indicated that it would also consider other types of applications, should any be submitted.

In response to that call, the Commission received ten applications. Of these, nine were applications for a new radio station to serve Calgary: seven for an ethnic station, one for an Indigenous station, and one for a community station. The Commission also received one application to amend the technical parameters of an existing ethnic station in the Calgary market.

Multiple applications, in some case even those proposing different frequencies, may be technically mutually exclusive with one another.

Several applicants proposed alternative frequencies and supported their proposals by providing technical suitability documentation. These proposals will be considered in this proceeding and are identified in this notice. Consistent with the approach set out in Broadcasting Notice of Consultation 2024-60, the Commission will withdraw any application from the public hearing if it is not advised by the Department of Industry (also known as Innovation, Science and Economic Development Canada), at least twenty days prior to the first day of the hearing, that the application is technically acceptable. The Commission must also be advised by the Department of Industry, at least twenty days prior to the first day of the hearing, that any alternative frequencies proposed by the applicant are technically acceptable. Otherwise, those frequencies shall not be considered as part of the proceeding.

In evaluating the present applications, the Commission will consider the following factors in each proposal: 

Additionally, in assessing these applications for a new radio service and the proposed technical amendment in the Calgary market, the Commission will consider the following factors, as set out in Decision 99-480:

The relative importance of each factor as described above will vary depending on the market’s specific circumstances and in light of the public interest.

The applications will be treated as competitive radio applications for the Calgary radio market. This means that if one or more applications are granted, others would have to be denied, as the market cannot accommodate all applicants.

The Commission encourages interested persons to monitor the public examination files and the Commission’s website for additional information that they may find useful when preparing their comments.

Diversity and Inclusion

The Broadcasting Act places emphasis on serving the diverse needs of all Canadians, including equity-deserving communities. This is reinforced by the 2023 Order Issuing Directions to the CRTC (Sustainable and Equitable Broadcasting Regulatory Framework).Footnote 1 Broadcasting Regulatory Policy 2022-332 also underscores the importance of ensuring that commercial radio reflects the diversity of Canadian society and supports underrepresented groups, including Indigenous peoples, Black and other racialized communities, and persons with disabilities. In this context, the Commission may consider how an applicant's programming, operations, and employment equity policies address the diversity of the communities in their proposed markets. While diversity and inclusion are not listed as formal evaluation criteria for licensing new radio stations under Decision 99-480, the Commission may use its discretion to consider these factors during the evaluation process. Applicants had or will have the opportunity to provide information relevant to diversity and inclusion during the licensing process.

Applications

The Commission will consider the following 10 applications, subject to interventions, during the appearing phase of the public hearing:

1. Fraser Media Diversity Inc.
Calgary, Alberta

Application by Fraser Media Diversity Inc. for a broadcasting licence to operate an English-language community FM radio station in Calgary, Alberta.

The station would operate at 100.3 MHz (channel 262A) with an effective radiated power (ERP) of 6,000 watts (non-directional antenna with an effective height of antenna above average terrain [EHAAT] of 36.6 metres).

The applicant proposed to broadcast 126 hours of local programming per broadcast week, of which 4 hours and 40 minutes would be devoted to local and regional news, 1 hour to national news, and 1 hour to international news.

The applicant indicated that it would adhere to a condition of service permitting it to devote a maximum of 17% of the programming broadcast on the station per broadcast week to French-language programming.

Should the Commission approve the application, it proposes to make orders pursuant to subsection 9.1(1) of the Broadcasting Act (the Act) requiring the licensee to adhere to:

2. Lossless Media Inc.

Application by Lossless Media Inc. for a broadcasting licence to operate an ethnic specialty commercial FM radio station in Calgary, Alberta.

The station would operate at 100.3 MHz (channel 262B1) with an effective radiated power (ERP) of 6,200 watts (non-directional antenna with an effective height of antenna above average terrain [EHAAT] of 334 metres).

The applicant also submitted an alternative proposal to operate the station at 102.7 MHz (channel 274B1) with an ERP of 1,000 watts (non-directional antenna with an EHAAT of 334 metres).

The applicant proposed to broadcast 100 hours of local programming per broadcast week, of which 5 hours would be devoted to local and regional news, 2 hours to national news, and 2 hours and 30 minutes to international news. 

The applicant committed to adhere to a condition of service requiring it to devote 15% of its musical selections aired per broadcast week during an ethnic programming period to Canadian selections. 

The applicant indicated that it would adhere to a condition of service requiring it to devote a minimum of 10% of its musical selections to musical selections by emerging Canadian artists.

The applicant further committed to contribute $420,000 over seven consecutive years to Canadian content development (CCD) as a condition of service.

The applicant indicated that it would devote, by condition of service, 100% of its total programming broadcast per broadcast week to ethnic programming and 91% to third language programming. It further indicated that it would adhere to a condition of service requiring that such programming be directed to at least 13 cultural groups in at least 8 different languages per broadcast week.

The applicant indicated that it would devote, by condition of service, 100% of its total programming broadcast per broadcast week to ethnic programming and 97% to third-language programming. It further indicated that it would adhere to a condition of service requiring that such programming be directed to at least 16 cultural groups in at least 22 different languages per broadcast week.

The applicant proposed to broadcast a minimum of 100 hours of local programming per broadcast week, of which 4 hours and 13 minutes would be devoted to local and regional news, 50 minutes to national news, and 58 minutes to international news.

The applicant committed to contribute $700,000 over seven consecutive years to Canadian content development (CCD) as a condition of service.

The applicant indicated that it would devote, by condition of service, 85% of its total programming broadcast per broadcast week to ethnic programming and 85% to third-language programming. It further indicated that it would adhere to a condition of service requiring that such programming be directed to at least 25 cultural groups in at least 14 different languages per broadcast week.

The station would operate at 100.3 MHz (channel 262B) with an effective radiated power (ERP) of 5,500 watts (non-directional antenna with an effective height of antenna above average terrain [EHAAT] of 336 metres).

The applicant proposed to broadcast 126 hours of programming per broadcast week, of which 106 hours would be devoted to local programming and 20 hours would be sourced from its existing radio station CIWE-FM Edmonton, Alberta.

The applicant also proposed to broadcast, per broadcast week, 100 hours of programming in the English language and 26 hours of programming in Blackfoot, Nakoda/Sioux, Dene, and Cree languages.

The applicant further proposed to devote 9 hours of its programming broadcast per broadcast week to spoken word programming, including 2 hours and 45 minutes to news and 117 hours to musical programming.

The applicant proposed to broadcast a minimum of 121 hours of local programming per broadcast week, of which 5 hours and 30 minutes would be devoted to local and regional news, 2 hours and 15 minutes to national news, and 3 hours and 15 minutes to international news.

The applicant indicated that it would adhere to a condition of service requiring it to devote a minimum of 5% of its musical selections to musical selections by emerging Canadian artists. 

The applicant committed to contribute $560,000 over seven consecutive years to Canadian content development (CCD) as a condition of service.

The applicant indicated that it would devote, by condition of service, 100% of its total programming broadcast per broadcast week to ethnic programming and 100% to third-language programming. It further indicated that it would adhere to a condition of service requiring that such programming be directed to at least 34 cultural groups in at least 14 different languages per broadcast week.

The applicant proposed to broadcast a minimum of 71 hours of local programming per broadcast week, of which 21 hours would be devoted to local and regional news, 10 hours and 30 minutes to national news, and 10 hours and 30 minutes to international news.

The applicant committed to devote, by condition of service, 10% of its musical selections aired per broadcast week during an ethnic programming period to Canadian selections.

The applicant indicated that it would adhere to a condition of service requiring it to devote a minimum of 5% of its musical selections to musical selections by emerging Canadian artists. 

The applicant would also adhere to a condition of service requiring it to devote a minimum of 20% of all programming broadcast per broadcast week to Indigenous programming. The applicant would broadcast Indigenous programming in a minimum of four Indigenous languages and may broadcast Indigenous programming in English.

The applicant further committed to contribute $49,000 over seven consecutive years to Canadian content development (CCD) as a condition of service. 

The applicant indicated that it would devote, by condition of service, 75% of its total programming broadcast per broadcast week to ethnic programming and 75% to third-language programming. It further indicated that it would adhere to a condition of service requiring that such programming be direct to at least 13 cultural groups in at least 13 different languages per broadcast week.

The applicant indicated that it would adhere to a condition of service permitting it to devote a maximum of 3% of the programming broadcast on the station per broadcast week to French-language programming.

The applicant committed to devote, by condition of service, 15% of its musical selections aired per broadcast week during an ethnic programming period to Canadian selections.

The applicant also indicated that it would adhere to a condition of service requiring it to devote a minimum of 5% of its musical selections to musical selections by emerging Canadian artists. 

The applicant further committed to contribute $345,000 over seven consecutive years to Canadian content development (CCD) as a condition of service.

The applicant indicated that it would devote, by condition of service, 100% of its total programming broadcast per broadcast week to ethnic programming and 80% to third-language programming. It further indicated that it would adhere to a condition of service requiring that such programming be directed to at least 36 cultural groups in at least 20 different languages per broadcast week.

9. Multicultural Broadcasting Corporation Inc.

Application by Multicultural Broadcasting Corporation Inc. to amend the broadcasting licence for the ethnic specialty commercial FM radio programming undertaking CKYR-FM Calgary, Alberta.

The applicant seeks to change its frequency from 106.7 MHz (channel 294B) to 100.3 MHz (channel 262C1), to increase the maximum effective radiated power (ERP) from 8,000 to 10,000 watts, to increase the average ERP from 1,100 to 52,900 watts, and to increase the effective height of antenna above average terrain (EHAAT) from 236 to 307.6 metres. All other technical parameters would remain unchanged.

The applicant also submitted alternative proposals to amend the technical parameters of the operational station:

The applicant indicated that its programming would remain unchanged. In particular, it would continue to broadcast 114 hours of local programming per broadcast week, of which 3 hours and 23 minutes would be devoted to local and regional news, 43 minutes to national news, and 43 minutes to international news.

The applicant also indicated that it would continue to devote, by condition of service, 100% of its total programming broadcast per broadcast week to ethnic programming and 90% to third-language programming. It further indicated that it would continue to adhere to a condition of service requiring that such programming be directed to at least 23 cultural groups in at least 19 different languages per broadcast week.

The applicant further indicated that it would continue to ensure that at least 10% of the content category 3 (Specialty Music) musical selections broadcast during ethnic programming periods during each broadcast week are Canadian selections.

However, should its application be approved, the applicant proposed a new expenditure requirement of $350,000 over seven consecutive years to Canadian content development (CCD) as a condition of service. Alternatively, should its application be approved for frequencies 105.7 FM or 107.9 FM, the applicant committed to contribute $105,000 over seven consecutive years to CCD as a condition of service.

In addition to the station’s existing conditions of service, should the Commission approve the application, it proposes to make orders pursuant to subsections 9.1(1) and 11.1(2) of the Broadcasting Act (the Act) requiring the licensee to adhere to:

Application by Devotional Broadcasting Limited for a broadcasting licence to operate an ethnic specialty commercial FM radio station in Calgary, Alberta. The applicant currently operates an exempt low-power station at 105.7 MHz (channel 289LP) and provides programming from a house of worship.

The station would operate at 105.7 MHz (channel 289B) with a maximum effective radiated power (ERP) of 8,000 watts, an average ERP of 2,890 watts, and a directional antenna with an effective height of antenna above average terrain (EHAAT) of 256.4 metres.

The applicant proposed to broadcast 126 hours of local programming per broadcast week, of which 7 hours would be devoted to local and regional news, 3 hours to national news, and 2 hours to international news.

The applicant committed to devote, by condition of service, at least 30% of all musical selections aired per broadcast week during ethnic programming periods to Canadian selections.

The applicant further committed to contribute $126,000 over seven consecutive years to Canadian content development (CCD) as a condition of service.

It further indicated that it would adhere to a condition of service requiring that such programming be directed to at least of 4 cultural groups in at least 4 different languages per broadcast week.

The Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure) apply to the present proceeding. Accordingly, the procedure set out below must be read in conjunction with the Rules of Procedure and related documents, which can be found on the Commission’s website under Acts and Regulations. The guidelines set out in Broadcasting and Telecom Information Bulletin 2010-959 provide information to help interested persons and parties understand the Rules of Procedure so that they can more effectively participate in Commission proceedings.

An intervention or answer from a respondent must be filed with the Commission and served on the applicant on or before the above-mentioned date. An answer from a respondent must also be served on any other respondent.

Interventions and answers must clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.

Interested persons and parties can coordinate, organize, and file, in a single submission, interventions by other interested persons or parties who share their position. Information on how to file this type of submission, known as a joint supporting intervention, as well as a template for the covering letter to be filed by the parties, can be found in Broadcasting Information Bulletin 2010-28-1.

The Commission encourages interested persons and parties to monitor the record of the proceeding, available on the Commission’s website, for additional information that they may find useful when preparing their submissions.

Submissions longer than five pages should include a summary. Each paragraph of all submissions should be numbered, and the line ***End of document*** should follow the last paragraph. This will help the Commission verify that the document has not been damaged during electronic transmission.

Pursuant to Broadcasting and Telecom Information Bulletin 2015-242, the Commission expects incorporated entities and associations, and encourages all interested persons and parties, to file submissions for Commission proceedings in accessible formats (for example, text-based file formats that allow text to be enlarged, modified, or read by screen readers). To provide assistance in this regard, the Commission has posted on its website guidelines for preparing documents in accessible formats.

A true copy of each intervention or answer from a respondent must be sent to the applicant and, in the case of a respondent to an application, to any other respondent.

Parties who send documents electronically must ensure that they will be able to prove, upon Commission request, that filing, or where required, service of a particular document was completed. Accordingly, parties must keep proof of the sending and receipt of each document for 180 days after the date on which the document is filed or served. The Commission advises parties who file or serve documents by electronic means to exercise caution when using e-mail for the service of documents, as it may be difficult to establish that service has occurred.

In accordance with the Rules of Procedure, a document must be received by the Commission and all relevant parties by 5 p.m. Vancouver time (8 p.m. Gatineau time) on the date it is due. Parties are responsible for ensuring the timely delivery of their submissions and will not be notified if their submissions are received after the deadline. Late submissions, including those due to postal delays, will not be considered by the Commission and will not be made part of the public record.

The Commission will not formally acknowledge submissions. It will, however, fully consider all submissions, which will form part of the public record of the proceeding, provided that the procedure for filing set out above has been followed.

In the event that an application to be considered during the non-appearing phase of the hearing is brought to an oral phase of the hearing, and if parties wish to appear, they must provide reasons why their written interventions or answers are not sufficient and why an appearance is necessary. Parties requiring communication support must state their request on the first page of their intervention. Only those parties whose requests to appear have been granted will be contacted by the Commission and invited to appear at the public hearing.
