Subject:Part 1 Application by 2332683 Ontario Inc., operating as Coextro, for non-discriminatory and timely access on reasonable terms and conditions to Toronto Standard Condominium Corporation 1782 Request for Information

Dear recipients,

The Canadian Radio-Television and Telecommunications Commission (the Commission) is an administrative tribunal responsible for the administration of the Telecommunications Act (the Act), and aims to, amongst other things, encourage competition to ensure that Canadians have a choice of telecommunication service providers (TSP).

2332683 Ontario Inc., operating as Coextro (Coextro), submitted the above-referenced Part 1 application. In its application, Coextro is requesting access to a multi-dwelling unit (MDU) located at 31 Bales Avenue in North York, Ontario, to install its equipment and provide telecommunications services to residents.

In a staff letter issued to Coextro and Toronto Standard Condominium Corporation 1782 (TSCC 1782) on 28 May 2024, Commission staff requested, among other things, a list of TSPs who had been granted access to the MDU for the purpose of installing their equipment and/or providing telecommunications services to residents/customers.

Section 37 of the Act provides that the Commission may require Canadian carriers or any person to file information or documents that the Commission considers necessary for the administration of that Act.

As part of its review of Coextro’s above-noted application, Commission staff would like to know whether parties have held further discussions on the matter and whether negotiations for access arrangements have progressed. We are therefore requesting Coextro and TSCC 1782 to provide a response to the attached questions by 30 May 2025, serving their response on the other party by the same date. Coextro, TSCC 1782 and any other interested person will then have an opportunity to file a reply by 4 June 2025. These replies must be limited to only the new information provided in the responses to the attached questions.

Recipients are reminded that their responses are required to be submitted electronically, and in full compliance with the applicable provisions of the CRTC Rules of Practice and Procedure. Your responses will become part of the public record and will be posted on the CRTC website.

As set out in section 39 of the Telecommunications Act, and in Broadcasting and Telecom Information Bulletin 2010-961 (Procedures for filing confidential information and requesting its disclosure in Commission proceedings), persons may designate certain information as confidential. A detailed explanation on why the designated information is confidential and why its disclosure would not be in the public interest must be provided, including why the specific direct harm that would be likely to result from the disclosure would outweigh the public interest in disclosure. In addition to the confidential version, an abridged version of the document omitting only the confidential information must be filed or reasons why an abridged version cannot be filed must be provided.

    1. details and evidence (if available) of any discussions that occurred, progress in negotiations and issues that have been resolved and that are remaining;

    2. the position of 2332683 Ontario Inc., operating as Coextro (Coextro) on the remaining issues to be negotiated.

  2. Provide a copy of your standard access agreement, which you indicated was also provided to TSCC 1782 on 6 December 2022.

  3. Provide any additional information or details that may be useful to the Commission in considering this file.

  3. Provide a copy of all agreements concluded between any TSP(s) and TSCC 1782 which provide the TSP(s) with access to the MDU for the purpose of installing their equipment and/or providing telecommunications services to residents/customers.

  4. Provide any additional information or details that may be useful to the Commission in considering this file.
