Subject: Application 2024-0630-6 – Amendment to the Mandatory Distribution Order of TV5 Québec Canada regarding the TV5/UNIS TV broadcasting licences to increase the mandatory wholesale rate – Request for comment relating to official language matters

TV5 Québec Canada is requesting an increase in the mandatory wholesale rate for its TV5/UNIS TV serviceFootnote 1, from $0.28 to $0.30 in French-language markets, and from $0.24 to $0.26 in English-language markets, an increase of $0.02 in each market.

Pursuant to section 5.2 of the Broadcasting Act, the Commission must consult with Official Language Minority Communities (OLMCs) when making decisions that could adversely affect them. Further, pursuant to section 41 of the Official Languages Act (OLA), measures taken under the OLA in respect of OLMCs must be based on analyses which include dialogue and consultation activities with OLMCs and other stakeholders.

The Act requires the system to reflect Canadian diversity and meet the needs of OLMCs by ensuring their representation in programming and facilitating access to content in their language. Through its programming, TV5/UNIS TV aims to foster the vitality of French-language minorities in Canada by supporting their development and onscreen representation.

In light of the above, Commission staff notes that additional time for OLMCs to comment on the application is needed to complete the record. Accordingly, Commission staff is launching an additional 15-day consultation period reserved exclusively for submissions from members of OLMCs and organizations whose primary mandate is to represent OLMCs. This period will allow them to comment on the file, particularly regarding the impact of the application on their communities and any (positive or mitigating) measures that could be taken to address these impacts. It should be noted that OLMC organizations that have already intervened in this process may still file additional comments during this period. Other OLMC members who submit comments during this period will be added as parties to the proceeding.

Deadline for filing a response: 27 May 2025.

Interveners must send a true copy of their submission to the applicant at the same time as their comments are filed.

The applicant will have a 5-day period to respond to the additional comments submitted by OLMCs.

Deadline for the applicant to file a reply: 2 June 2025.
