Subject: Part 1 Application to amend OUTtv's broadcasting licence - Application 2024-0538-1
In order for the Commission to complete the analysis of OUTtv’s application to amend its broadcasting license, please respond to the following questions:
Questions
- If the Commission were to grant OUTtv mandatory distribution of the service on the digital basic service, pursuant to section 9.1(1)(h) of the Broadcasting Act by all BDUs with more than 2,000 subscribers in anglophone markets, with no option to negotiate package and rates with BDUs, would OUTtv find this acceptable?
- Are the proposed amendments to OUTtv's conditions of service exclusively tied to the approval of mandatory distribution as part of the basic service at a wholesale fee of $0.12?
- Please detail what impact, if any, there would be on the proposed conditions of service should the Commission deny mandatory distribution or approve a rate less than $0.12 per subscriber sought.
- Section 4.3 of the application form 301 requires the applicant to provide three years of financial projections (revenues and expenses), with and without approval of the proposed amendment(s). Please submit the financial projections (both the confidential and the abridged versions) without approval.
Your answers to the questions must be received no later than 12th February 2025 and will be placed on the public record, accessible through the CRTC website. Please repeat the Commission’s questions before answering them and use the secure service My CRTC Account (Partner Log In or GCKey), indicating the application number 2024-0538-1.
