Subject: Consolidated Part I Application Review and Vary Telecom Regulatory Policy 2024-180, Competition in Canada’s Internet service markets – Requests for Information
Good morning/afternoon,
As you know, by Secretary General letter dated 25 November 2024, the Commission set out a consolidated process to consider three applications to review and vary Telecom Regulatory Policy 2024-180 (TRP 2024-180). Attached to this letter is a second set of requests for information (RFIs) for that process. A first set of RFIs seeking detailed information was issued on 10 December 2024; however, this set of RFIs seeks broader information related to the issues raised in the consolidated process.
Responses to the RFIs must be filed with the Commission and served on the persons included in the distribution list accompanying this letter. These responses must be received by the Commission no later than 7 January 2025.
All parties that participated in the proceeding that led to TRP 2024-180 are to respond to the questions addressed to “all parties”. For all other questions, recipients are to respond to the questions that are addressed to them.
As set out in section 39 of the Telecommunications Act and in Broadcasting and Telecom Information Bulletin CRTC 2010-961, Procedures for filing confidential information and requesting its disclosure in Commission proceedings, persons may designate certain information as confidential. A person designating information as confidential must provide a detailed explanation on why the designated information is confidential and why its disclosure would not be in the public interest, including why the specific direct harm that would be likely to result from the disclosure would outweigh the public interest in disclosure. Furthermore, a person designating information as confidential must either file an abridged version of the document omitting only the information designated as confidential or provide reasons why an abridged version cannot be filed.
Parties and interested persons may request the public disclosure of information that has been designated as confidential in responses to the attached RFIs, setting out in each case the reasons for disclosure. These disclosure requests are to be filed in a single letter along with those related to the RFIs issued on 10 December 2024 and must be filed with the Commission and served on the parties to whom they are addressed by 14 January 2025. Responses to requests for public disclosure must be filed with the Commission and served to the requesting parties by 17 January 2025.

All Parties
- In the proceeding that led to TRP 2024-180, certain parties told the Commission that it could be beneficial to allow incumbentsFootnote1 to use wholesale services. In particular:
- the Commissioner of Competition stated that allowing incumbents to use wholesale services outside of their traditional serving territories would likely create greater competition for both Internet and other telecommunications services;Footnote2 and
- PIAC and Open Media submitted that consumer interests may be best served by the Commission allowing incumbent access to wholesale services.Footnote3
Explain whether the Commission could achieve its goal of increasing competition to create more choice and lower consumer prices if it were to deny some or all incumbents from accessing wholesale services. Distinguish between the situations where: (a) all incumbents are prohibited from accessing wholesale services; and (b) only Bell Canada, Rogers Communications Canada Inc., TELUS Communications Inc., and their affiliates are prohibited.
Incumbents and other ISPs
- List all companies or organizations with whom you have discussed an off-tariff agreement for the provision of wholesale HSA services following the release of TRP 2024-180 (i.e., on or after 13 August 2024). Provide details on the terms of such agreements, as well as a copy of every draft agreement that you sent or received during this period.
- Provide a copy of each internal document prepared for or received by senior executives created between 13 August 2024 and today’s date, that discusses the impact of TRP 2024-180 or Telecom Order 2024-261.
