Subject: Procedural directions related to applications to review and vary the wholesale high-speed access framework

The Commission has recently received applications to review and vary aspects of the Commission’s wholesale high-speed access (HSA) framework set out in Telecom Regulatory Policy 2024-180 (TRP 2024-180):
On 7 November 2024, Cogeco, the Canadian Network Operators of Canada, and Eastlink requested that the policy be varied so that Bell Canada, Rogers, and Telus are not eligible to access mandated HSA services anywhere in Canada. This application was posted under file number 8662-C6-202405753.
On 12 November 2024, Rogers requested that the policy be varied to address several determinations, including Bell Canada, Rogers, and Telus’ eligibility to use wholesale HSA services. This application was posted under file number 8662-R28-202405836.
On 12 November 2024, Teksavvy requested that the policy be varied to address certain limitations that apply to aggregated FTTP access. This application was posted under file number 8662-T117-202405844.
In the interests of efficiency and timeliness, we are consolidating these applications as follows:
All documents filed under file numbers 8662-R28-202405836 and 8662-T117-202405844 will be consolidated to file number 8662-C6-202405753.
If you wish to file an intervention in this consolidated process, please do so using file number 8662-C6-202405753 by 7 January 2025.
Requests for the public disclosure of information designated confidential in parties’ interventions must be filed with the Commission and served to the relevant parties by 14 January 2025.
Responses to requests for public disclosure must be filed with the Commission and served to the requesting parties by 17 January 2025.
The Commission will undertake to promptly issue determinations on public disclosure requests.
Parties may file replies to interventions by 13 February 2025.
Commission staff will soon issue a letter requesting additional information from stakeholders that participated in the proceeding. The letter will outline the process for providing responses and public disclosure of information designated confidential.
The Commission notes that on 30 October 2024, Telus filed a distinct application to review and vary TRP 2024-180, focusing solely on the implementation deadline. This application will be addressed separately through its own process.
