RE: Application 2023-0088-8 – Bayshore Broadcasting Corporation - New FM radio station in Owen Sound, Ontario, to replace the AM station CFOS

Dear Kevin Brown,

Further to new information relating to application 2023-0088-8 for a new broadcasting licence to operate an English-language commercial FM radio station in Owen Sound, Ontario, to replace the existing AM station CFOS, Commission staff is requesting clarification on a particular issue.

Low-power radio stations affected by the application

In section 4.2 of the application, you indicated “N/A” to the question asking you to provide a list of low-power radio stations that may be affected by your application.

Innovation, Science and Economic Development Canada (ISED) informed the Commission that a low-power station, VF3000 Southampton, Ontario, would have to vacate its current frequency further to Bayshore Broadcasting Corporation’s application for a new FM station should the application be approved by the Commission.

Commission staff notes that in accordance with section 22 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure(Rules of procedure), an applicant must serve its application on a respondent, which is defined as a person who is “adverse in interest” and includes those stations whose frequencies overlap with your new proposed frequency. Additional guidance is provided at paragraphs 59-61 of Guidelines on the CRTC Rules of Practice and Procedure, Broadcasting and Telecom Information Bulletin CRTC 2010-959, 23 December 2010.

In light of the above, in order to comply with the Rules of Procedure, you are requested to serve the application on radio stations overlapping your proposed transmitter’s 3mV/m primary contour, and any other respondents the applicant identifies, by 17 April 2024.

Note that a document is not served until it is received by the intended recipient. Therefore, if you are serving a person by mail, you must send it in time for it to be received on or before 17 April 2024. For greater clarity, you are required to provide them with the complete application materials.

Considering the above request, the Commission will re-publish the application for additional comments. The timelines for the additional process will be as follows:
