Subject: Application 2023-0310-6 – Amendment of Conditions of service - CFED-FM Edmonton, Alberta – Derogation to the CRTC Rules of Practice and Procedure in order to process the application

The Commission has received the above-noted application to amend the conditions of service of the French-language community radio station CFED-FM Edmonton, Alberta.

The Société Radio Communautaire du Grand Edmonton Society (known as Radio Cité) is seeking the Commission’s approval to allow the French-language community radio station CFED-FM to broadcast a certain number of hours per week of English-language programming produced by a third party, in order to alleviate financial difficulties. It indicates that without this modification, the station's precarious financial situation will result in its closure and will cease operations.

Pursuant to sections 5.2 (1) and 5.2 (2) of the Broadcasting Act, the Commission must consult Official Language Minority Communities (OLMCs) when it is likely to make any decision that could have a prejudicial effect on them.

The Commission is of the view that this application could have a detrimental effect on OLMCs. The Commission invites OLMC members to consult the application that was published today on the Commission’s website. However, in an exception to the Rules of Practice and Procedure ("the Rules"), the Commission has added an additional intervention period, reserved exclusively for OLMC members. This period will follow the usual intervention period, allowing OLMC members to comment on the initial application as well as the interventions of other parties as it relates to the impact of the application on OLMCs.

For the purposes of the second intervention period, the Commission will pay particular attention to the official languages issues raised by this application, and will consider positive measures to mitigate any possible direct negative impacts on OLMCs.

The procedure described below applies only to application 2023-0310-6 and does not constitute a predetermination on other Part I applications and should not be seen or understood as amending the Rules of Procedure with respect to Part 1 applications.  The Commission, in consultation with OLMC members, will consider more definitive amendments to the Rules of Procedure in due course.

Intervention and reply periods concerning the application

  1. First intervention period of 30 days following the date of publication of the application. All interested parties may file their interventions, in accordance with article 26(1) of the Rules of Procedure. Deadline for filing an intervention: 23 February 2024.
  2. New: Additional intervention period reserved exclusively for OLMC members, 20 days following the deadline for the first interventions. Deadline for filing an intervention: 14 March 2024.
  3. Applicant’s reply, 10 days following the second intervention period, in accordance with article 27(1) of the Rules of Procedure. Deadline for the applicant to file a reply: 25 March 2024.

The public record will be closed 25 March 2024. The Commission will proceed with deliberation of the file and may consider further procedural steps before issuing its final decision.
