Subject: TELUS Communications Company's intention to expand within NorthernTel, Limited Partnership's operating territory as a competitive local exchange carrier

Dear Philippe Gauvin:

On 14 November 2012, Commission staff sent a letter to NorthernTel Limited Partnership (NorthernTel) regarding the entry of TELUS Communications Inc. (TELUS) as a competitive local exchange carrier (CLEC) in the exchange of Timmins, Ontario. In that letter, the Commission noted NorthernTel had indicated that all associated work for TELUS to begin operating in the Timmins exchange was anticipated to be completed in the first quarter of 2013.Footnote1 TELUS was to advise the Commission once the implementation was finalized and it was able to start offering its services in the exchange of Timmins, Ontario. However, that notification had not been provided to the Commission when the letter was issued.

In a letter to the Commission dated 13 November 2023, TELUS proposed to operate as a Type I CLEC in the Ontario exchanges of Hearst, Kapuskasing, Kirkland Lake, New Liskeard, South Porcupine, Timmins, and Haileybury. TELUS stated it had met all the necessary obligations to do so, and it proposed a service date for these exchanges of 4 December 2023. On 4 December 2023, the Commission received a letter from NorthernTel following this expression of interest by TELUS to provide competitive services in the above-noted exchanges.  In that letter, NorthernTel noted TELUS’ prior expression of interest in 2012, and indicated that, in relation to TELUS’ current expression of interest, its Carrier Service Group has been in contact with TELUS on the necessary technical and administrative tasks and procedures involved in TELUS’ market expansion.

Following industry procedures with regards to local number portability and other technical aspects involved in the project, NorthernTel confirmed that all associated work for implementation would be completed in time to meet TELUS’ anticipated launch date of 4 December 2023. NorthernTel further confirmed that there were no additional competitor services or implementation issues associated with TELUS’ plan, the interconnection would follow the processes and technical requirements already in use in NorthernTel’s territory, there was no specific cost recovery associated with the interconnection, and that it would inform the Commission of any situation arising from the project that would impact implementation or its associated costs.

NorthernTel additionally submitted that it had signed a new Schedule C to the existing master agreement for local interconnection in Timmins with TELUS, which TELUS had filed with the Commission.

Since i) all work and requirements for entry into the exchanges TELUS has proposed to operate in have been completed, ii) there is no specific additional cost recovery associated with TELUS’ expansion into these exchanges, and iii) the notification requirements for CLECs set out in Telecom Decision CRTC 2012-396 have been met, Commission staff confirms that TELUS can begin offering its services in the above noted exchanges effective immediately.
