Subject: Request for final offer arbitration regarding mobile virtual network operator (MVNO) access rates

Dear Peggy Tabet and Stephen Schmidt,

On 9 November 2023, the Commission received a letter from Québecor Média Inc. (QMI), on behalf of Vidéotron ltée. (Videotron) and Freedom Mobile Inc. (Freedom), requesting final offer arbitration (FOA) for the purpose of establishing rates for the provision of MVNO access service between Videotron and TELUS Communications Inc. (TCI).

In order to ensure that the Commission has sufficient information to determine the appropriate scope of the MVNO FOA process, both parties are to provide answers to the information requested below by no later than 17 November 2023, serving a copy to the other party.

Firstly, please provide:

It should be noted that as indicated in Telecom Decision 2022-288Footnote1, the Commission has determined that tariff terms must include support for one-way seamless handoff. Commission staff therefore expects the proposed tariff format and structure to include one-way seamless handoff.

Further, staff requests that QMI comment on TCI’s proposal that parties engage in Staff Assisted Mediation (SAM) and indicate whether it would accept to participate in SAM?

In accordance with paragraph 59 of Information Bulletin 2019-184Footnote2, existing Commission confidentiality rules and practices apply to FOA proceedings. The applicable rules and practices are set out in the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules) and described in Broadcasting and Telecom Information Bulletin 2010-961Footnote3

Commission staff advises that documents relating to this request, including the present letter, may be made public.
