Télébec, Société en commandite – Final approval of a tariff application
Application
- The Commission received an application from Télébec, Société en commandite (Télébec), Tariff Notice (TN) 534, dated 4 May 2023, in which the company proposed a change to its rates for local long distance. Specifically, the company proposed to introduce a monthly rate range for additional circuits and/or channels in item 3.1.2.2.a) of its General Tariff. The company also submitted a rate ratification request with regards to the same service.
- Télébec stated that in a previous application, TN 527, it had increased the monthly rate for additional circuits and/or channels from $12.01 to $13.03, effective 1 January 2023. The company had intended to introduce a rate range at that time; however, due to an administrative error, the change was filed as a simple price increase. To correct that error, the company submitted the proposed rate range in the present application.
- Télébec proposed a maximum amount of $13.03 per month for the new rate range, but submitted the minimum amount in confidence.
- Télébec noted that, after the above-mentioned price increase took effect on 1 January 2023, it continued to bill customers of the service at the former rate of $12.01 per month. The company requested that the Commission ratify the charging of that rate from 1 January 2023 until the effective date of the proposed rate range.
- In Télébec, Société en commandite – Interim approval of a tariff application, Telecom Order CRTC 2023-151, 19 May 2023, the Commission approved Télébec’s application on an interim basis, with an effective date of 19 May 2023. The Commission stated that it would address the ratification request in a subsequent order.
- The Commission received no comments regarding the application.
Commission’s analysis
- Pursuant to subsection 25(4) of the Telecommunications Act, the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.
- Given that customers continued to be charged at the previous monthly rate of $12.01 after the higher rate became effective, the Commission is satisfied that there was an administrative error in the previous application, and that the requested ratification is warranted.
- Accordingly, the Commission finds Télébec’s request for rate ratification to be reasonable.
Conclusion
- The Commission approves on a final basis Télébec’s application and, in light of the above, ratifies the rate of $12.01 per month for the above-noted service for the period from 1 January 2023 to 19 May 2023, the date of interim approval of this application.
