Dear Mr. Carnes,

This is in reference to the above-noted application by CKUA Radio Foundation for an amendment to the broadcasting licence of CKUA-FM Edmonton, AB, in order to amend the technical parameters of its rebroadcasting transmitter CKUA-FM-13 Drumheller, AB.

In order to assess this application, please address the following questions:

Annual Returns Filed Incomplete – Missing Financial Statements

Pursuant to subsection 9(2) of the Radio Regulations, 1986, (the Regulations), licensees are required to file, no later than 30 November of each year, their annual return for the broadcast year ending the previous 31 August. Failure to file these returns, in whole or in part, by the required date of 30 November of each year, may result in apparent non-compliance.

According to Commission records, although the annual returns for the 2018-2019 and 2019-2020 broadcast years were filed on time, they were incomplete. More specifically, the financial statements were filed late, on 29 March 2021 for both broadcast years. Therefore, it appears that the licensee of CKUA‐FM may be in non‐compliance with subsection 9(2) of the Regulations, relating to the filing of dully completed annual returns for the 2018-2019 and 2019-2020 broadcast years.

In light of the information above:

  1. Please explain the circumstances of this apparent non‐compliance.
  2. Please specify what measures have been or will be put in place to ensure full compliance with subsection 9(2) of the Regulations in the future.

Please note that any instances of apparent non-compliance will be dealt with at the time of the licence renewal for CKUA-FM.

Commission staff request the aforementioned information by no later than 9 August 2021.
