Re: Broadcasting Notice of Consultation CRTC 2020-262.  Procedural Letter - Radius Holdings Inc. (“Radius”) Kelowna, British Columbia.  

The Commission is in receipt of a letter dated 23 September 2020, filed jointly by Jim Pattison Broadcast Group Ltd. (the general partner) and Jim Pattison Industries Ltd. (the limited partner), carrying on business as Jim Pattison Broadcast Group Limited Partnership and by Stingray Radio Inc. (the intervenors), in which the intervenors have provided additional comments in response to application no. 2020-0373-9 (the “second intervention”).  The intervenors seek to have the second intervention added to the record of this proceeding.

The Commission is also in receipt of a letter dated 24 September 2020, filed on behalf of both the applicant, Radius Holdings Inc., and Grant Thornton Limited (in its capacity as trustee in the bankruptcy of Avenue Radio Ltd.), objecting to the second intervention being added to the record of this proceeding.  Alternatively, they request that the applicant be provided an opportunity to respond within a reasonable period of time in advance of the 13 October 2020 hearing.

As per Broadcasting Notice of Consultation CRTC 2020-262, the deadline for the filing of interventions was 10 September 2020 and consequently the intervenors’ second intervention was filed out of process. However, the Commission considers that it is in the public interest to allow the second intervention to be added to the public record of this proceeding.  In this regard, the second intervention provides additional pertinent information for the Commission’s consideration and will provide for a more fulsome and complete record. 

However, in order to ensure that the applicant can appropriately respond to the second intervention, the Commission also accords the applicant with the right to file a final reply by 5 October 2020. The Commission reminds the applicant that the final reply must be received and not merely sent by this date. Further, the applicant’s reply must be restricted to the points raised by the intervenors in their second intervention. 

Given that this additional time for reply results in the record closing less than 10 days before the commencement of the public hearing, as an exception to section 36(1) of the Rules of Procedure, the Commission will notify any party it requests to appear in relation to this matter not less than 5 days before the commencement of the public hearing.

A copy of this letter will be placed on the public record of this proceeding.
