Background
- On 14 August 2020, the Commission issued Telecom Decision 2020-268, in which it concluded that both Iristel Inc. (Iristel) and TELUS Communications Inc. (TCI) had violated subsection 27(2) of the Telecommunications Act (the Act) in relation to routing and terminating phone calls to the 867 area code in Northern Canada.
- On the same day, the Commission issued Telecom Notice of Consultation 2020-269, in which it initiated a proceeding to determine whether it would be appropriate to impose administrative monetary penalties (AMPs) on Iristel and TCI and, if so, in what amountsFootnote 1 (the proceeding).
- Iristel submitted an application to the Commission on 2 September 2020, requesting the Commission review, vary, rescind, and stay certain aspects of Telecom Decision 2020-268. In its application, Iristel disputed, among other things, the determination that it had violated subsection 27(2) of the Act.
- The outcome of Iristel’s application to review and vary Telecom Decision 2020-268 might have affected the proceeding and as a result, the Commission considered that it would have been inappropriate to continue with the proceeding at that time.
- On 11 September 2020, the Commission adjourned the proceeding initiated by Telecom Notice of Consultation 2020-269, pending the outcome of Iristel’s review and vary application.
- On 6 November 2020, TCI also submitted an application to the Commission requesting that it review and vary Telecom Decision 2020-268. It also disputed the finding that it had violated subsection 27(2) of the Act.
- On 1 December 2021, the Commission issued Telecom Decisions 2021-397 and 2021-398, in which it denied Iristel’s and TCI’s respective applications to review and vary Telecom Decision 2020-268 and maintained its determinations that Iristel and TCI violated subsection 27(2) of the Act.
Resumption of consultation and revised deadlines
- Accordingly, the Commission resumes the consultation with respect to the imposition of administrative monetary penalties on Iristel and TCI.
- The process set out in Telecom Notice of Consultation 2020-269 applies, with the following revised deadlines:
- Interested parties may file interventions with the Commission no later than 17 January 2022.
- Iristel and TCI may file replies to the interventions with the Commission no later than 31 January 2022.
