Subject: Part 1 Broadcasting Application – 2019-0510-1 (CJCN-FM Surrey)

Dear Tejinder Singh Saini,

This is in reference to the above-noted application by Akash Broadcasting Inc. (Akash) for a technical amendment to change the authorized service contours of the unlaunched commercial specialty ethnic FM radio station (CJCN-FM) in Surrey, British Columbia.

In order to pursue the analysis of this application, please address the following.

Respondents

Pursuant to section 22(1)b) of the CRTC Rules of Procedure (“The Rules”), an application must be served on any respondent. A respondent is defined in section 1 of the Rules as “a person that is adverse in interest to an applicant”. The guidelines on the Rules include a chart of persons generally considered to be respondents (paragraph 61). The list is not exhaustive since parties that can be considered respondents depend on the specific facts of the application.

We note that you have not served your application on any respondents.

In light of the above, you are therefore required to serve the application on the incumbent ethnic radio licensees that service Surrey by 19 July 2019. Note that a document is not served until it is received by the intended recipient. Therefore, if you are serving a person by mail, you must send it in time for it to be delivered on or before 19 July 2019.

Furthermore, as per section 8 of the application form, Respondents, please revise the chart below with the required information as stated in the Rules.
