Penalty: $60,000
Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38(the Act), the undersigned has issued this notice of violation finding Sutton (Québec) Services Immobiliers Inc. to have committed the following violations contrary to the Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:
On and between 1 November 2013 – to 30 November 2015, Sutton (Québec) Services Immobiliers Inc. obtained and disclosed contents of the National Do Not Call List (National DNCL) to persons outside of their organization, resulting in violations of:
- Part II, section 10 of the Rules which states that a telemarketer, a client of a telemarketer, and any other subscriber of the National DNCL shall not sell, rent, lease, publish or otherwise disclose, whether, for consideration or not, the National DNCL or any portion thereof to any person outside of its organization, including any affiliate.
Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $60,000.
The penalty of $60,000 must be paid to "The Receiver General for Canada" in accordance with subsection 72.09(3) of the Act.
