Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38 (the Act), the undersigned has issued this Notice of Violation finding Club Cranberry Vacations Inc. to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission (CRTC) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:
On or between 24 January 2014 to 2 August 2016, telemarketing telecommunications were made by Club Cranberry Vacations Inc. resulting in violations of the following Rules: Part II, section 4 for initiating telemarketing telecommunications to consumers whose telephone numbers were registered on the National Do Not Call List (National DNCL); Part II, section 6 of the Rules for initiating telemarketing telecommunications during periods when Club Cranberry Vacations Inc. was not subscribed to the National DNCL; Part II, section 13 for using a version of the National DNCL that was older than 31 days; and Part III, section 29 of the Rules for exceeding the 5% abandonment rate while using a predictive dialing device.
Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $100,000.
The penalty of $100,000 must be paid by Club Cranberry Vacations Inc. to “The Receiver General for Canada” in accordance with subsection 72.09(3) of the Act.
