Mr. Martineau,
In order to pursue the analysis of the above-mentioned application, please answer the following questions:

Withdrawal of application 2015-1273-1

  1. It is staff understanding that this application 2016-1045-2 replaces the initial application 2015-1273-1.  Therefore, you wish to withdraw your initial application 2015-1273-1, and consequently, the Commission will not proceed with the above noted application. As such, this application will be considered closed and the Commission will dispose of any related documents.

    Please confirm that the information set out in paragraph 2 above is accurate and complete.

Update – Annual returns – Financial statements

  1. In the context of your initial licence amendment application no 2015-1273-1, in a letter dated 23 November 2015, staff informed the licensee of its situation of apparent non-compliance with section 9(2) of the Radio Regulations, 1986 (the Regulations) regarding the filing, by no later than 30 November of each year, of the annual return for the broadcast year ending the previous 31 August.

    Specifically, although the annual returns for the 2013-2014 broadcast year were filed in a timely manner by the licensee, the financial statements were missing.  Further to this correspondence, staff confirms the receipt, on 27 November 2015, of the missing financial statements. 
    The Commission will review Radio communautaire de Châteauguay's non-compliance at its next licence renewal in 2020Footnote 1 , consitent with its approach set out in Information bulletin CRTC 2014-608Footnote 2 . Based on this approach, each case of non-compliance is evaluated in its context and in light of factors such as the quantity, recurrence and seriousness of the non-compliance. The the circumstances that have led to the non-compliance, the arguments provided by the licensee, as well as the actions taken to rectify the situation are also considered.

    Please confirm that you have read and understood the above. 

Technical information

  1. The technical information provided in the chart under section 4 of the application form does not reflect the information in the technical brief filed with the application. Please confirm:
    • The current MAXIMUM - Effective Radiated Power (ERP);
    • The proposed MAXIMUM ERP;  and
    • The current Antenna Radiation Pattern

Financial information

  1. According to staff, it appears that the proposed technical change will result in a slight increase in the authorized contours of the station.  However, based on the information provided at section 7.2 of the application form, the licensee does not anticipate any increase in the population served within the station's authorized contours.  In light of this:
    • Please confirm that the information provided at section 7.2 are complete and accurate.
    • If not, please file an amended version of section 7.2.

The information requested herein should be received by the Commission no later than 12 October 2016, failing which, your application may be returned to be completed and resubmitted with the Commission should you wish to pursue this proposal.

It is important to note that in the absence of a response on your part by the specified deadline, the licensee will be in a situation of apparent non-compliance with section 9(4) of the Regulations which requires licensees to respond to Commission requests for information relating to adherence to their regulatory obligations. 

We also ask that you repeat each question in your reply.

A copy of this letter and all correspondence related to your application will be added to the public record of the proceeding.
