Re: Broadcasting application 2015-0776-6 (CKRZ-FM Ohsweken)

Dear Mr. Gauthier,

This letter is in reference to the Part 1 application submitted to the Commission by SONICS Inc. for a technical amendment to CKRZ-FM Ohsweken. In order to pursue the analysis of the above noted application, please address the following:

Financial analysis and considerations

  1. In section 6.4 of the application form, you have indicated that the proposed amendment would not have a financial impact on other stations in the market.
  2. However, in Broadcasting Decision CRTC 2014-583, the Commission approved an application by Arrow Radio for a broadcasting licence to operate a new Type B Native FM radio station in Ohsweken, Ontario.

    Please explain why the proposed amendment would not have any impact on Arrow Radio’s new station.

Respondents

  1. Pursuant to section 22(1) b) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure), an application must be served on any respondent. A respondent is defined in section 1 of the Rules of Procedure as “a person that is adverse in interest to an applicant”. The onus is on applicants to clearly identify and provide service of an application to all respondents.Footnote 1

    In the present case, Arrow Radio was not identified as a respondent served in section 8 of your application form. Commission staff is of the view that Arrow Radio could be adverse in interest to your application.

    In light of the above, you are required to serve your application on Arrow Radio, including your response to the previous question in this letter, by no later than 27 June 2016. Note that a document is not served until it is received by the intended recipient. Therefore, if you are serving a person by mail, you must send it in time for it to be delivered on or before 27June 2016.

    Furthermore, please revise the chart below with the required information as stated in the Rules of Procedure.
