Re: Application by Star Choice Television Network Incorporated – request for additional information and revised dates with regard to the Part 1 process

Dear Sir,

We received your application wherein you requested that the Commission approve a condition of licence (COL) that would apply to Star Choice Television Network Incorporated (Shaw Direct), as an exception to section 45.1 of the Broadcasting Distribution Regulations (the Regulations).

While you requested that the Commission deal with this on an expedited administrative basis, this is not merely an implementation issue. Therefore, a process that includes the opportunity for public comment is more appropriate.

In order to process this application in a timely fashion, the Part 1 process is modified as follows:

Shaw Direct has until 27 January 2016 to respond to the questions attached to the letter.

Interested persons have until 5 February 2016 to submit interventions relating to the application.

Shaw Direct has until 8 February 2016 to reply to the interventions.

A copy of this letter, the answers to the questions, and your reply will be added to the record of this proceeding and made available for public examination.

We also ask that you repeat each question in your reply.

The Commission requires that your response and/or other documents be submitted electronically by using the secured service “My CRTC Account” (Partner Log In or GCKey) and filling in the “Broadcasting and Telecom Cover page” or the “Broadcasting Online Form and Cover Page” located on this web page. Questions re: application 2016-0080-0

  1. In the application, you request a condition of licence (COL) that would permit Shaw Direct to offer a distinct basic service for each of the following areas: British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec and the Atlantic provinces, instead of a discrete basic service to each of approximately 40 local television markets.
    1. For each area noted above, provide a complete list of the television stations that would form part of the basic service.
    2. Provide, if applicable, what basic service would apply outside these areas; for example in Yukon, the Northwest Territories and Nunavut.
  2. In the application, you state that it would be extremely costly to comply with s.45.1 of the Broadcasting Distribution Regulations (the Regulations).
    1. Provide a detailed explanation of what measures would have to be taken with respect to the current billing system in order for Shaw Direct Incorporated to be in compliance with the Regulations.
    2. Provide an estimate of the costs that would be incurred and the amount of time it would take to implement these changes.
  3. You request that the COL in question apply until such time as Shaw Direct has the technical ability to fully implement section 45.1 of the Broadcasting Distribution Regulations (the Regulations).
    1. Provide a date by when Shaw Direct will be able to implement section 45.1 of the Regulations.
