Dear Mr. Hill,

Commission staff requests public disclosure of the following information that you designated as confidential with respect to the above-noted proceeding.

In each case, Commission staff considers that the information should be placed on the public file.

In your letter dated 8 May 2015 you submitted that the revenues and operating expenses contained in the AVR Three Year Operating Budget fall within the type of information usually designated as confidential under the Appendix to the Broadcasting and Telecom Information Bulletin CRTC 2010-961 (CRTC 2010-961).

However, the Appendix to CRTC 2010-961 indicates that projections (financial statements and assumptions) for years in the prospective licence term of an applicant to a radio licence renewal are generally public, with the sole exception being the breakdown of revenues and operating expenses. Commission staff considers that the relevant information noted above does not fit into this exception.

In each case where disclosure is requested, Commission staff considers that any specific direct harm caused by disclosure would not outweigh the public interest in disclosure of the relevant information.

In response to this request for disclosure, Aboriginal Voices Radio Inc. must either:

  1. file a revised abridged version of the document reflecting the above request by no later than 9:00 a.m. Gatineau time on 13 May 2015, serving copies on all parties by the same date; or
  2. file a copy to Commission staff’s request for disclosure, addressing the reasons why, in the licensee’s view, the relevant information should not be disclosed, by no later than 9:00 a.m. Gatineau time on 13 May 2015.

The Commission requires that your response and/or other documents be submitted electronically by using the secured service “My CRTC Account” (Partner Log In or GCKey) and filling in the “Broadcasting and Telecom Cover page” or the “Broadcasting Online Form and Cover Page” located on this web page. Also on this web page you will find information on the submission of applications to the Commission “Submitting applications and other documents to the CRTC using My CRTC Account.”
